  <br />1 <br />483433v3 NE136-8 <br />City of New Brighton, Minnesota <br />Agreement for Residential Recycling Services <br /> <br />This Agreement (“Agreement”, also referred to as “Contract”) is made this ____ day of <br />____________________, 2016, between the City of New Brighton, 803 Old Highway 8 NW, <br />New Brighton, Minnesota 55112 (the “City”) and Republic Services Recycling of the Twin <br />Cities, LLC, a Delaware limited liability company d/b/a Republic Services of the Twin Cities- <br />Eden Prairie (the “Contractor”). <br /> <br />WITNESSETH: <br /> <br />WHEREAS, the City supports curbside collection of residential recyclable materials and <br />desires that it be made available to its residents; and <br /> <br />WHEREAS, the Contractor has submitted to the City a proposal for residential curbside <br />collection, processing, and marketing of recyclable materials; and <br /> <br />WHEREAS, the City desires the Contractor to pick up recyclable materials throughout <br />the City’s municipal limits, process them and market them in accordance with the terms of this <br />Agreement; <br /> <br />NOW, THEREFORE, the City and the Contractor mutually agree as follows, in <br />consideration of the mutual promises and covenants contained herein: <br /> <br />1. DEFINITIONS <br /> <br />1.1 Aluminum Cans <br /> <br />Disposable containers fabricated primarily of aluminum, commonly used for soda, beer, <br />juice, water or other beverages. <br /> <br />1.2 Contractor <br /> <br />Republic Services Recycling of the Twin Cities, LLC, d/b/a Republic Services of the <br />Twin Cities – Eden Prairie (f/k/a Allied Waste Services) the City’s recycling service <br />contractor under this Agreement beginning operation on January 1, 2011. <br /> <br />1.3 Curbside <br /> <br />The area of public right of way between the property line and the curb or edge of the <br />street, but not on the street. <br /> <br />1.4 Curbside Recycling Carts <br /> <br />Uniform curbside single sort recycling carts in which recyclable materials can be stored <br />and later placed for curbside collection, as specified by the City.
