I:\Commissions - NEW FOLDER\Planning Commission\2016\Working Docs\2016.03.15\WTP#1 SUP\LP2016-001, SP2016-003 (City of New <br />Brighton) - RESOLUTION.doc 1 <br />RESOLUTION <br />PLANNING COMMISSION <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF A SITE PLAN AND <br />SPECIAL USE PERMIT. <br /> <br />WHEREAS, an application has been made by the City of New Brighton to permit improvements at <br />Water Treatment Plant #1 (WTP1), including construction of a new Distribution Control Station <br />(DCS), plant expansion of approximately 6,200 SF, and associated utility, storm water, and <br />landscaping improvements at 3001 5th Street NW, and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1. Applications for a Site Plan and Special Use Permit were completed on February 25, 2016. <br />2. A notice for public hearing was posted in the March 2, 2016 edition of the New Brighton <br />Bulletin <br />3. Public hearing notices were mailed to the property owners within 350’ of the subject property <br />on March 3, 2016. <br />4. Pursuant to published and mailed notice, the Planning Commission held a public hearing on <br />March 15, 2016 and all present were given a chance to freely speak at the hearing. <br />5. The Planning Commission recommended approval on March 15, 2016, subject to conditions. <br /> <br />WHEREAS, the Planning Commission makes the following Findings of Fact with respect to the Site <br />Plan (LP2016-001) and Special Use Permit (SP2016-003): <br />1. The property is zoned R – 1, Single Family Residential. <br />2. The property is guided in the New Brighton Comprehensive Plan for P-QP, Public-Quasi <br />Public. <br />3. The property is located at 3001 5th Street NW. <br />4. The proposed improvements include construction of a freestanding building to be used as a <br />Distribution Control Station, an expansion to the existing plant, and associated utility, storm <br />water, and landscaping improvements. <br />5. The Planning Commission considered the Site Plan in accordance with the R – 1 district <br />standards of Section 4-040, Chapter 11 (Parking Standards), and applicable performance <br />standards of Section 6-390 of the Zoning Code. <br />6. The Planning Commission found all applicable Site Plan standards to be compliance with <br />Zoning Code regulations. <br />7. Zoning Code Section 4-030 requires a Special Use Permit for service structures, including <br />deep wells, elevated tanks, and similar structures and uses. <br />8. The Planning Commission reviewed the proposed improvements against the following <br />special use permit criteria of Zoning Code Section 8-130: <br />a. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare. <br />b. That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhood.
