Commissioner Danger was in favor of tabling action on this item for further discussion or stated he would be voting against the Planning Case. He stated he supported the seminary having a K-8 school but believed they should be a part of the approval process. Mr. Beck understood these points but reiterated that he could not secure a tenant without an SUP in place. Commissioner Fynewever appreciated the fact that the staff recommendation had taken into consideration how the adjacent residents would be impacted and was offering 12 conditions within the SUP. Planning Director Gundlach reported under State Statute the City had to act on a Land Use Application request within 60 days. She stated the Planning Commission could not legally deny the request because the tenant was unknown. She commented the only way the request could be denied would be if the Planning Commission determined a specific impact that would constitute non-compliance with the Special Use standards and were discussed within the Planning Commission's packet. These specific determinations would have to be listed. She explained that if the Commission were to take no action on the matter within the 60 day timeframe, the request would be approved as submitted and no conditions could be imposed. Chairperson Nichols-Matkaiti requested the Commission return their discussion to the conditions for approval. Commissioner Fynewever stated she could support staffs recommendation regarding the hours of operation and did not recommend the school be allowed to remain open until 7:00 pm. She stated she could support the school remaining open until 6:00 pm. Ms. Klunke believed that the City should allow the school to remain open until 7:00 pm in order for the school to be allowed to host concerts and art events. The Commission was in favor of allowing the school to remain open until 6:00 pm. Sheri Troje, 3009 Seminary Drive, recommended no outside playground use be allowed at 5:30 pm or 6:00 pm, except for special events. She asked that trees be planted around the playground in order to create a barrier between the seminary and the neighboring houses. The consensus of the Commission was to allow the following: School activities (hours of operation) shall be limited to Monday thru Friday from 7 am to 6 pm. Up to eight (8) exceptions to these hours shall be permitted per school year for special events, except that special events shall limit outdoor activities as follows: a. Monday thru Friday: No outdoor activities past 8 pm b. Saturday: No outdoor activities past 3 pm C. Sunday: No outdoor activities allowed Planning Director Gundlach clarified that activities that took place indoors would not require an exception, only events that occurred outdoors would require an exception. Commissioner Frischman requested this language be further clarified prior to this item being reviewed by the City Council. Commissioner Fynewever recommended that no outdoor play be allowed after 5 pm without an exception. Commissioner Frischman questioned if the playground portion of the SUP could be left open-ended. Planning Director Gundlach stated the City could be creative with how this condition was written. 7
