B. There shall be a minimum setback of the height of the building, or sixty feet, whichever <br />is greater, from any property zoned R-l or R-2. Subject to approval of the City Council, <br />the setbacks referenced in this sub-section may be decreased for any new Planned Unit <br />Development that is located in the area known as the Northwest Quadrant project area, as <br />defined by the Northwest Quadrant Framework Plan approved by the City Council on <br />June 28, 2005. <br /> <br />This standard does not apply in that no adjacent land is zoned R-1 or R-2 or is forecasted <br />to be used for residential purposes. <br /> <br />C. There shall be a minimum setback of the height of the building, or sixty feet, whichever is <br />greater, from any public street. Subject to approval of the City Council, the setbacks <br />referenced in this sub-section may be decreased for any new Planned Unit Development <br />that is located in the area known as the Northwest Quadrant project area, as defined by <br />the Northwest Quadrant Framework Plan approved by the City Council on June 28, 2005. <br /> <br /> This standard is met. The proposed building is 103’ from the property line abutting 14th <br />ST NW and 100’ from the property line abutting Northwest Parkway. It should be noted <br />the future expansion space is proposed to have a setback to Northwest Parkway of 10’. <br />This is permitted exception under this standard as the Northwest Quadrant Framework <br />Plan specifies building facades abutting, and prominently facing the public roadway. <br /> <br />(9) Any improvement, such as streets, sidewalks, or utilities to be located on or in land dedicated <br />to the public, shall be ordered and financed in accordance with Sections 25-16 through 25-45 of <br />the City Code. <br /> <br />The applicant will enter into a Subdivision Agreement outlining responsibilities for public <br />improvements. <br /> <br />Based on the above analysis, all PUD standards of Section 7-230 are met. <br /> <br />PUD Approval Criteria <br />Section 7-240 outlines criteria for the Planning Commission and City Council to consider when <br />reviewing a Planned Unit Development. The Planning Commission, when making a <br />recommendation to the City Council, shall consider the following factors (staff responses in <br />italics): <br /> <br />(1) The consistency of the proposed development with the adopted or proposed comprehensive <br />plan for the City. <br /> <br />The Comprehensive Plan has the New Brighton Exchange redevelopment area guided for City <br />Center, which consists of a variety of uses, including office. Based on the characteristics of the <br />Site Plan, staff finds the proposed development to meet this criterion. <br /> <br />(2) The extent to which the proposed development is designed to form a desirable and unified <br />environment within its own boundaries in terms of relationship of structures, patterns of <br />circulation, visual character, and sufficiency of drainage and utilities. <br />
