adjacent and nearby uses not being impacted by its activity. To staff’s knowledge, the <br />drive-thru is already open past midnight and no complaints have been received. <br /> <br />I. Any menu/ordering signage interior to the site with an intercom shall not be audible from <br />residentially zoned property and if illuminated shall be directed away from residentially <br />zoned property. <br /> <br />Staff finds this criterion to be met. No residential property is nearby or adjacent. <br /> <br />J. Fencing and or landscaping may be required to shield head-light illumination from <br />adjacent and nearby areas. <br /> <br />Staff finds this criterion to be met. No residential uses are nearby that could be impacted <br />by head-light illumination, thus, no fencing or landscaping shall be required. <br /> <br />Based on the above analysis, all drive-thru criteria noted in Zoning Code Section 11-020(10) are <br />met. <br /> <br />In addition to the drive-thru standards in Zoning Code Section 11-020(10), the special use <br />standards in Zoning Code Section 8-130 must also be considered. Section 8-130 states that no <br />special use shall be recommended by the Planning Commission unless it shall find (staff <br />responses in italics): <br /> <br />(1) That the establishment, maintenance, or operations of the special use will not be detrimental <br />to or endanger the public health, safety, morals, comfort or general welfare. <br /> <br />Staff finds this criterion to be met. The drive-thru is existing and the improvements proposed <br />will only have a positive impact to the public health, safety, morals, comfort or general welfare. <br /> <br />(2) That the special use will not be injurious to the use and enjoyment of other property in the <br />immediate vicinity for the purposes already permitted, nor substantially diminish and impair <br />property values within the neighborhood. <br /> <br />Staff finds this criterion to be met. The drive-thru is existing and the proposed revisions to the <br />stacking lanes, signage, and landscaping will only impact the use and enjoyment of other <br />property in the immediate vicinity and improve upon property values in the neighborhood. <br /> <br />(3) That the establishment of the special use will not impede the normal and orderly development <br />and improvement of the surrounding property for uses permitted in the district. <br /> <br />Staff finds this criterion to be met. This area is nearly fully developed and any future <br />reinvestment or redevelopment will not impeded by these improvements. <br /> <br />(4) That adequate utilities, access roads, drainage and/or necessary facilities have been or are <br />being provided. <br />
