<br /> <br />2 <br /> <br />flowing through the property and explained the proposed sidewalk would offer a designated connection for <br />pedestrians and would keep them off the grass. <br /> <br />Chair Nichols-Matkaiti asked if it was appropriate to require a sidewalk connection from the applicant when <br />their request was for drive-thru improvements. Planning Director Gundlach reported this was discussed by staff <br />and it was deemed the sidewalk addressed the general health and welfare of the public and therefore was <br />deemed appropriate under the special use criteria. She indicated the Commission could pull this requirement if <br />there was a determination it didn’t relate to the general health and wefare of the public. <br /> <br />Kevin Shay, Landform Professional Services, commented the sidewalk connection was brought up to <br />McDonald’s and they were receptive. However, they are looking to make the sidewalk ADA compliant. He <br />described how the sidewalk would have to be oriented in order to become ADA compliant. Planning Director <br />Gundlach stated it would be better if the sidewalk was ADA compliant, but staff was willing to be flexible in <br />order to have the site improved from the existing conditions. <br /> <br />Commissioner Fynewever was pleased the site was making improvements to become more accessible. <br /> <br />Jeff Smith, owner of McDonald’s, thanked the Commission for their consideration and stated he supported the <br />proposed sidewalk improvements. He looked forward to having the work done in order for the site to be more <br />accessible for his customers. <br /> <br /> <br />Motion by Commissioner Murphy, seconded by Commissioner Miwa to close the Public Hearing. <br /> <br />Approved 6-0. <br /> <br /> <br />Commissioner Fynewever supported the addition of the sidewalk as it fits with the motive behind McDonald’s <br />renovations. <br /> <br />Commissioner Jones stated he would like to strike the sidewalk condition as the sidewalk had nothing to do <br />with the drive-thru. <br /> <br />Commissioner Fynewever requested further information on the City’s Special Use Permit requirements. <br />Planning Director Gundlach reviewed the City’s Special Use Permit requirements with the Commission and <br />noted the general health, safety and welfare standards. She read Item 4 stating the sidewalk request fit into the <br />use and enjoyment of the property and noted adequate utilities or facilities to the site were necessary. <br /> <br />Commissioner Fynewever asked if the sidewalk were removed if the Council could be made aware that this <br />action was taken by the Planning Commission. Planning Director Gundlach indicated staff could make the <br />Council aware of this decision. <br /> <br />Chair Nichols-Matkaiti questioned how the Commission would like to proceed. <br /> <br />Commissioner Jones requested an amendment to staff’s recommendation striking the words: and subject to <br />incorporation of a sidewalk connection diagonally from the pedestrian ramp at the southwest corner of <br />Innsbruck Drive and Silver Lake Road, southwest to the applicant’s parking lot. <br />
