*Variance requested <br /> <br />Zoning Code Section 4-030 (1) states that “colleges, libraries, museums, schools, churches and <br />similar public uses provided that no structure shall be nearer than thirty feet to any R-1 or R-2 lot <br />line”. Additionally, Section 0-010 (64) defines structure as “anything erected, the use of which <br />requires more or less a permanent location on the ground or attachment to something having a <br />permanent location on the ground”. These two sections require the reconstructed parking lot to <br />meet a 30’ setback to all property boundaries as all adjoining properties are zoned R-1. Chapter <br />11 of the Zoning Code, titled Parking Standards, normally requires a 30’ front yard setback and <br />15’ side and rear yard setbacks, however the increased setback of Section 4-030 (1) for special <br />uses supersedes the parking lot setback provided in Chapter 11. The applicant has made <br />application for a Variance for the 17.4’ western side yard setback when 30’ would normally be <br />required and 40’ currently exists. <br /> <br />Parking <br />While no additional building space is proposed, and thus no additional parking would be <br />required, staff felt it was appropriate to provide information concerning required off-street <br />parking and available off-street parking to alleviate some neighbor concerns that have been <br />voiced. <br /> <br />Zoning Code Section 11-030 (3) requires off-street parking for junior high schools to be <br />provided based on the following calculation: <br /> <br />1 stall for every classroom + 1 stalls for every 50 students <br /> <br />Information was not provided with regard to the number of classrooms since the scope of work <br />did not include interior changes to the school. However, for the purposes of this exercise staff <br />assumed all 99 staff had their own classroom at Highview (99 teachers are noted on Highview’s <br />website). This calculation would require the following: <br /> <br />(1 x 99) + (843 students/50 students) = 99 + 17 = 116 off-street parking stalls <br /> <br />It should be recognized that it is highly unlikely that all 99 teaches have their own classroom that <br />they don’t share with another teacher. Additionally, the 99 staff includes the principal, assistant <br />principals, and deans, which staff understands do not have their classrooms. <br /> <br />Thus, this highly conservative calculation would demand 116 off-street parking stalls. The <br />existing parking lot contains 110 stalls and the proposed reconstructed parking lot would contain <br />129 parking stalls. This equates to a net increase of 19 parking stalls and compliance with the <br />requirements of Zoning Code Section 11-030 (3). <br /> <br />This analysis should not be construed to require Highview to have 116 off-street parking stalls, <br />rather the purpose was to demonstrate the off-street parking stall count meets minimum <br />standards. A more accurate analysis could be completed if the actual classrooms were depicted <br />on floor plans of all levels of the school. Staff doesn’t find this to be necessary for this request <br />and, if provided, would most likely reduce the required number of off-street parking stalls.
