SPECIAL USE PERMIT ANALYSIS <br />The applicant wishes to keep one to five trailers on site for sale at any given time. The <br />applicant’s primary business is renting and storing intermodal storage containers. The property <br />at 565 1st Street SW contains a small office building and a storage yard for the trailers. The <br />applicant’s narrative indicates they keep the for-sale trailers in a designated location on-site, <br />however the submitted plan does not specifically depict the designated area. Staff would <br />recommend the applicant provide a plan depicting the for-sale trailer storage spaces. <br /> <br />Zoning Code Section 8-130 states that no special use shall be recommended by the Planning <br />Commission unless the following findings are made (staff responses in italics): <br /> <br />a. That the establishment, maintenance, or operations of the special use will not be detrimental <br />to or endanger the public health, safety, morals, comfort of the general public. <br /> <br /> Staff finds this criterion to be met. The surrounding area consists of heavy industrial uses, <br />many of which store heavy machinery on the property. The allowance of one-five for-sale <br />trailers will not be detrimental to or endanger the public health, safety, morals, or comfort of <br />the general public. <br /> <br />b. That the special use will not be injurious to the use and enjoyment of other property in the <br />immediate vicinity for the purposes already permitted, nor substantially diminish and impair <br />property values within the neighborhood. <br /> <br /> Staff finds this criterion to be met. The property is located within a heavy industrial area of <br />the City, which is fully developed with heavy industrial uses that utilize outdoor storage. <br />Based upon the applicant’s primary business of renting and storage intermodal storage <br />trailers, the allowance of one-five of these being for-sale with not otherwise impact <br />enjoyment of other property or diminish or impair property values in the neighborhood. <br /> <br />c. That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the district. <br /> <br /> Staff finds this criterion to be met. The area is fully developed with heavy industrial uses that <br />already utilize outdoor storage. Additionally, there are uses nearby that also engage in truck <br />and trailer sales. <br /> <br />d. That adequate utilities, access roads, drainage and/or necessary facilities have been or are <br />being provided. <br /> <br /> Staff finds this criterion to be met. The introduction of sales, not-to-exceed five trailers, will <br />not negatively impact the adequacy of utilities, access roads, drainage, etc. <br /> <br />e. That the special use shall, in all other respects, conform to the applicable regulations of the <br />district in which it located. <br />
