Special Use Permit – Bel Air Elementary <br />Planning Commission Report; 12-18-18 <br /> <br /> <br />Page 8 <br />Special Use Permit Review <br />In General: The need for a Special Use Permit is triggered by the specific use of “school” <br />within the R-1 District. Any future additions or site plan changes would also need <br />to go through this process for approval prior to being implemented. <br /> <br />Criteria Review: <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />Zoning Code Section 8-130 contains five standards the City must review prior to making <br />a decision on any specially permitted use. The applicant’s response to each criteria can <br />be found in their narrative above, and staff analysis of each standard is shown below: <br />1. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general <br />welfare. <br />STAFF COMMENTS: Staff finds this criterion to be met. The property has been <br />used as a school for decades and the expansion of the cafeteria, addition of <br />classrooms, and redesigning of the bus drop off area will improve the site and <br />increase student safety. The property is appropriately maintained and operations of <br />the school have not negatively impacted the neighborhood. Further, responding to <br />increasing district enrollment by providing additional classrooms should be viewed <br />as a positive addition. <br />2. That the special use will not be injurious to the use and enjoyment of other <br />property in the immediate vicinity for the purposes already permitted, nor <br />substantially diminish and impair property values within the neighborhood. <br />STAFF COMMENTS: Staff finds this criterion to be met. The proposed site work <br />is consistent with what is already occurring on the property, and the proposed <br />improvements should have a positive impact on property values in the <br />neighborhood. <br /> <br />3. That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in <br />the district. <br />STAFF COMMENTS: Staff finds this criterion to be met. Schools are almost <br />always located in residential districts and it is not uncommon for periodic <br />improvements to be made to address increasing enrollment. Additionally, the <br />proposed addition meets all zoning standards of the residential chapter of the Zoning <br />Code and the 30’ required setback to adjacent residential uses. Beyond the school <br />property, the area is fully developed. <br /> <br /> <br /> <br />
