Consideration of a Resolution vacating a partial Sanitary Sewer Easement, that <br />portion that lies across 475 & 487 Old Highway 8 NW. <br />Motion by Councilmember Jacobsen, seconded by Councilmember Burg to adopt a Resolution <br />approving the vacation of a portion of sanitary sewer easement lying north/south across 475 & 487 <br />Old Highway 8 NW. <br />City Manager Lotter indicated Assistant Director of Community Assets and Development/Planning Director <br />Gundlach would be presenting this item to the Council. <br />Assistant Director of Community Assets and Development/Planning Director Gundlach explained the <br />Micom site at 475 and 487 Old Highway 8 NW is currently vacant and for sale. Several <br />potential buyers have conducted due diligence efforts, which resulted in a current Certificate of <br />Survey to be completed. Upon examination of the survey, it was revealed a sanitary sewer <br />easement exists north/south across both 475 and 487 Old Highway 8 NW. This easement was <br />executed on November 23, 1960 and recorded on January 30, 1963 as Document No. 1582737. <br />This sanitary sewer easement runs beneath the building lying most easterly on the site and is <br />one of two sanitary sewer easements on the property in favor of the City of New Brighton. City <br />staff has examined the easement area and determined no utilities lie within this corridor of the <br />easement. As such, staff would recommend the portion of the sanitary sewer easement <br />recorded as Document No. 1582737 lying across 475 and 487 Old Highway 8 NW be vacated <br />as it serves no public use currently, nor would there be future public use of this easement. It <br />was noted the Resolution describes legally the area proposed to be vacated. Easement <br />vacations require a public hearing before the City Council. The City's Zoning Code is silent on <br />vacation requests. Absence City Zoning Code regulations, staff has provided notice of this <br />public hearing per Minnesota Statutes 412.851, publishing a notice of the hearing in the June <br />20th and June 27th editions of the New Brighton Bulletin.
