June 11, 2019 Page 3 of 4 <br /> <br />Motion by Councilmember Dunsworth, seconded by Councilmember Jacobsen to approve the <br />Consent Agenda as presented. <br /> <br />Councilmember Burg thanked the Bel Air PTA for their generous donation to the City. She encouraged the <br />Edward Jones representative to introduce themselves to the public. <br />Thomas Hoffman, Edward Jones, introduced himself to the Council and described the financial planning <br />services he would be providing to the community. <br />Councilmember Burg requested Ben Karp from Ramsey County come forward to discuss the Rice Creek <br />North Regional Trail Master Plan. <br />Ben Karp, Ramsey County Parks and Recreation, explained the County was in the final phases of completing <br />the Rice Creek North Regional Trail Master Plan. He reported this was a 14-mile regional trail corridor that <br />stretched from the Anoka chain of lakes down to the Mississippi River. He reported this trail hooks into Long <br />Lake in New Brighton. He commented further on the improvements that would be made to the trailheads <br /> <br />4 Ayes, 0 Nays - Motion Carried <br /> <br />Public Hearing <br /> <br />None. <br /> <br />Council Business <br />1. Consider Resolution to Amend Tobacco Ordinance. <br /> <br />Motion by Councilmember Burg, seconded by Councilmember Dunsworth to Adopt Ordinance No. <br />862 regarding Tobacco Regulations and Adopt a Resolution approving a Summary Publication of <br />Ordinance No. 862. <br /> <br />City Manager Lotter indicated Public Safety Director Paetznick would be presenting this item to the Council. <br />Public Safety Director Paetznick stated per Council direction following the public hearing last month, the City <br />Attorney has drafted an ordinance amendment to raise the age of purchase for tobacco products to 21 with no <br />restriction on the sale of all flavored products in the City of New Brighton. The updated draft also allows for <br />self-service displays and sampling in a tobacco or vapor products shop, consistent with Minnesota Statutes <br />Section 144.4167 (permitted smoking). <br />Mayor Johnson asked how the Council felt about 16-year olds being allowed to sell tobacco. She stated she <br />would prefer to see this age raised to 18. <br />Councilmember Burg questioned if this would be hindrance on the City’s local business owners. <br />Al Norse explained he doesn’t hire anyone under the age of 18 for legal reasons. <br />Councilmember Dunsworth stated this matter gave her reason to pause originally, but after learning more <br />than one person typically worked at a time and that the majority of employees were 18+ she could support <br />this recommendation. <br />Councilmember Jacobsen asked how the current Ordinance addressed the age for the sale of tobacco. Public <br />Safety Director Paetznick reported the current Ordinance was silent on this matter. <br />Councilmember Jacobsen explained he would support the Ordinance remaining silent on this matter. <br />Mayor Johnson supported the Ordinance remaining silent on this matter as well. <br />Councilmember Burg thanked the public for coming forward and speaking on this topic. She stated it was <br />heartwarming to see the community coming forward to address this topic in order to protect todays youth. <br />Councilmember Jacobsen noted 34 cities had passed legislation regarding Tobacco 21.
