<br /> <br />4 <br /> <br />2) Ordinance 877: Interim Use Permits. <br />Assistant Director of Community Assets and Development Gozola reported cities are allowed to use a <br />number of tools established by State Statute for overseeing land uses within their borders. One such <br />tool, the “Interim Use Permit,” is especially useful in situations where the City would like to permit a <br />use, but also identify a specific sunset date or trigger that would end the use. A recent land use <br />application before the City highlighted the fact that Interim Use Permits currently cannot be issued <br />as the New Brighton Zoning Ordinance has never been amended to include the tool. Ordinance 877 <br />would rectify this omission. Staff provided further comment on the proposed Interim Use Permit <br />language and recommended approval of Ordinance 877. <br />Chair Nichols-Matkaiti asked if IUP’s were rather standard tool for cities. Assistant Director of <br />Community Assets and Development Gozola reported this was the case. He indicated IUP’s were a <br />newer tool created by the legislature. <br />Chair Nichols-Matkaiti questioned if IUP’s would have an end date. Assistant Director of Community <br />Assets and Development Gozola stated IUP’s would be effective for two years and then would have <br />to be renewed. <br />Commissioner Biedenfeld thanked staff for bringing this back to the Commission in such a timely <br />manner. <br />Commissioner Enanaa asked if a permit could be terminated prior to two years. Assistant Director of <br />Community Assets and Development Gozola commented if conditions within the IUP were violate d, a <br />permit could be terminated prior to two years. <br />Chair Nichols-Matkaiti opened the Public Hearing at 7:36 p.m. <br />Motion by Commissioner Allen, seconded by Commissioner Biedenfeld to close the Public Hearing. <br />A roll call vote was taken. Approved 6-0. <br />Chair Nichols-Matkaiti thanked staff for working so quickly to bring this Ordinance forward. <br />Motion by Commissioner Frischman, seconded by Commissioner McQuillan, to recommend the <br />City Council approve Ordinance 877, an Ordinance identifying and establis hing certain interim uses <br />and the process for the issuance of interim use permits within the City of New Brighton . <br />A roll call vote was taken. Approved 6-0. <br /> <br /> <br /> <br />
