2 <br />WHEREAS, the City Council considered on January 22nd, 2019, the recommendations of the <br />Planning Commission, Staff, the Applicant's submissions, the contents of the staff report, and other <br />evidence available to the Council. <br /> <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of New Brighton <br />hereby approves the requested special use permit based on the following findings of fact: <br />1. The subject property is guided for public/quasi-public use by the 2030 comprehensive plan, <br />and schools are a specially permitted use in the corresponding R-1 zoning district. <br />2. All proposed building additions will meet required setbacks, and proposed building materials <br />are allowed by code. <br />3. Proposed lighting for the site meets all code requirements. <br />4. The traffic study completed by Wenck Associates shows that all access points to the school on <br />Long Lake Road will continue to operate at acceptable levels of service post construction. <br />5. Continued operation of a school at the proposed location will not be detrimental to or <br />endanger the public health, safety, morals, comfort, or general welfare of the community. <br />6. The proposed school improvements will not further impact the use and enjoyment of the <br />subject and surrounding properties provided conditions regarding parking and traffic are <br />adhered to. <br />7. The significant investment in school improvements will not have detrimental impact on area <br />property values. <br />8. The proposed updates to the High School will have no impact on the subsequent development <br />(or redevelopment) of surrounding property. <br />9. The subject site appears to be adequately served by public utilities, roads, and drainage <br />facilities to accommodate the proposed use; <br />10. The special use will be in conformance with all underlying zoning district requirements. <br />11. The requested variances are in harmony with the general purpose of the zoning code as the <br />applicant has successfully presented a site plan that properly balances public needs being <br />served against minimum required standards. <br />12. The proposed auditorium is setback from neighboring property over four times the requested <br />height ensuring there will be no impacts to adjacent lands. <br />13. Substantial plantings lining the southern parking lot successfully mitigates the proposed <br />setback from the ROW. <br />14. The variance requests are consistent with the Comprehensive Plan. <br />15. The applicant has established there are practical difficulties to support the requested <br />variances in that: <br />a. The requests are reasonable because: <br />i. The existing parking deficit on site is being reduced, not expanded;
