RESOLUTION ____ <br />CITY COUNCIL <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A PRELIMINARY <br />PLANNED RESIDENTIAL DEVELOPMENT TO AUTHORIZE APPLICATION FOR A FINAL <br />PLANNED RESIDENTIAL DEVELOPMENT FOR IMPROVEMENTS TO THE <br />BENEDICTINE HEALTH CENTER LOCATED AT 1101 BLACK OAK DRIVE <br /> <br />WHEREAS, the City of New Brighton is a municipal corporation, organized and existing under the <br />laws of the State of Minnesota; and, <br /> <br />WHEREAS, the City Council of the City of the New Brighton has adopted a 2030 comprehensive <br />plan and corresponding zoning regulations to promote orderly development and utilization of land <br />within the city; and, <br /> <br />WHEREAS, the City Council of the City of the New Brighton has approved a new 2040 <br />comprehensive plan and is awaiting authorization from the Metropolitan Council to put the new plan <br />into effect; and, <br /> <br />WHEREAS, the Benedictine Health Center at Innsbruck (the “Applicant”) is seeking to make <br />improvements to their property located at 1101 Black Oak Drive which is legally described as shown <br />on Exhibit A; and: <br /> <br />WHEREAS, the subject property is guided for “Mixed Use Regional” development by the new <br />2040 Comprehensive Plan, and the City has yet to write specific zoning standards which correspond <br />to this new land use category; and <br /> <br />WHEREAS, the Applicant has elected to propose a Planned Residential Development with <br />improvements intended to conform with the goals and objectives of the new 2040 Comprehensive <br />Plan rather than wait for new zoning to be created for Mixed Use Regional land use guidance; and <br /> <br />WHEREAS, the purpose of a Planned Residential Development (PRD) is to allow for flexible <br />development that can grant variations in “…density, bulk, height, setbacks, and other regulations <br />pertaining to the use of land…that are not in strict accordance with the other provisions of the <br />Zoning Code or any other ordinance of the City” provided the applicant can show the development is <br />not detrimental to the public; and <br /> <br />WHEREAS, Section 7-060(11) of the City’s zoning code provides further flexibility for PRDs in <br />stating that “all or any of the foregoing [referencing PRD standards] may be modified as deemed <br />necessary by the City Council for the preservation of the public health, safety, morals, and general <br />welfare of the residents of the planned residential development and the City;” and
