Page 1 of 4 <br /> <br />RESOLUTION <br />CITY COUNCIL <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT <br />AND SITE PLAN AUTHORIZING A WAREHOUSING & ASSEMBLY FACILITY AT 3595 <br />NEW BRIGHTON ROAD <br /> <br />WHEREAS, the City of New Brighton is a municipal corporation, organized and existing under the <br />laws of the State of Minnesota; and, <br /> <br />WHEREAS, the City Council of the City of the New Brighton has adopted a comprehensive plan <br />and corresponding zoning regulations to promote orderly development and utilization of land within <br />the city; and, <br /> <br />WHEREAS, JBL Investments LLC owns the property located at 3595 New Brighton Road in New <br />Brighton legally described as: <br />Lots 1, 2, 3, 4, 5, 6, 26, 27, 28, 29 and 30, Block 1, Vermont Park, together with that <br />part of vacated Clinton Street which accrued to said lots by reason of the vacation <br />thereof, according to the recorded plat thereof, Ramsey County, Minnesota. <br />Abstract Property <br /> <br />WHEREAS, JBL Investments LLC also owns the adjacent property located at 3661 New Brighton <br />Road in Arden Hills legally described as: <br />Lot 44, Rohleder's Home and Garden Acres, according to the recorded plat thereof, <br />Ramsey County, Minnesota <br />Torrens Certificate No. 309091 <br /> <br />WHEREAS, JBL Investments LLC (the “Applicants”) made application to the City on 8/16/19 for a <br />Special Use Permit (SUP) and Site Plan approval to authorize a warehousing and assembly facility <br />to be operated by Zahl Petroleum; and <br /> <br />WHEREAS, staff fully reviewed the request and prepared a report for consideration by the Planning <br />Commission at their meeting on September 17th, 2019; and <br /> <br />WHEREAS, the Planning Commission held a public hearing on the request at the September 17th <br />meeting and considered input from residents; and <br /> <br />WHEREAS, the Planning Commission recommended approval of the request on September 17th, <br />2019, based on the applicant’s submittals and findings of fact; and <br />
