Page 2 of 4 <br /> <br />WHEREAS, the City Council considered on September 24th, 2019, the recommendations of the <br />Planning Commission, Staff, the Applicant's submissions, the contents of the staff report, and other <br />evidence available to the Council. <br /> <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of New Brighton <br />hereby approves the requested special use permit and site plan based on the following findings of <br />fact: <br />1. The proposed outdoor storage will not be detrimental to the public health or general welfare <br />provided all materials are stored per an approved plan; <br />2. The proposed storage will not impact the use of surrounding properties, and will not impact <br />surrounding property values; <br />3. The proposed storage will not have any impact on the normal and ordinary development of <br />surrounding properties; <br />4. The subject site is adequately served by municipal utilities and infrastructure; <br />5. The proposed use can conform to all underlying zoning district requirements. <br /> <br />BE IT FURTHER RESOLVED, that approval of the special use permit amendment shall be <br />subject to the following conditions: <br />1. The existing building in the NE corner of the property that is bisected by municipal boundary <br />lines of Arden Hills and New Brighton shall be removed. <br />2. Proposed fencing along New Brighton Road shall be black vinyl chain link with vertical vinyl <br />slats to provide required screening. <br />3. Above ground storage tanks and other outside storage, if/when stacked, shall not exceed the <br />height maximum in the I-1 district (currently 40’). <br />4. The applicant shall submit a planting plan subject to approval by the City forester showing <br />coniferous trees in logical/gap locations along the northern property line, plantings of native <br />natural grasses around the building, and (if possible) inclusion of a natural stormwater amenity <br />(i.e. rain garden or bioswale) as part of the final stormwater management plan for the site. <br />5. All lighting shall be directed downward and installed so as to prevent direct light from being <br />detectable at the lot line; lighting is also not to shine directly into the public right-of-way. <br />6. The applicant shall have their surveyor do all necessary due diligence to identify the current <br />status of the alleyway on the updated survey. <br />a) If vacated, the non-vacated area around the lift-station shall be protected via mechanisms <br />agreed to with the Department of Community Assets and Development. <br />b) If NOT vacated, the applicant shall initiate a request for the City to vacate any unnecessary <br />portion of the alley,
