Final Planned Residential Development <br />Planning Commission Report; 11-19-19 <br /> <br /> <br />Page 5 <br />(cont.)  In addition to ensuring the development plans comply with preliminary approvals, <br />the Planning Commission and Council are to examine the final plat to determine <br />compliance with the City’s subdivision codes in Chapter 26. <br />o Was the final plat received within one year of preliminary approval (or within <br />one year of the last phase being approved)? <br />Yes. Phase I was approved on July 23rd, 2019. <br />o Was the final plat prepared by a land surveyor, and do the documents <br />conform to all State and County requirements? <br />Yes. The proposed plat was prepared by Max L. Stanislowski, Licensed Land <br />Surveyor. The City Attorney has not expressed any concerns to date, and <br />minor corrections can still be made prior to filing if need be. <br />o Do the final plat documents provide all information to be shown as called for <br />by Section 26-41(2) of the City’s Subdivision Codes? <br />Yes. All necessary information is shown on the final plat. <br />o Are park dedication requirements being met by the final plat? <br />Yes. Dedication will be satisfied via cash-in-lieu of land per a developer’s <br />agreement being prepared. Per the Preliminary PRD approval, the dedication <br />for the workforce building will be $286,525. It is anticipated that dedications <br />from the three Midtown Village projects will be used to build out the public <br />park dedicated as part of Phase I. <br />o Has a title opinion been provided and reviewed by the City Attorney? <br />On-going. The applicant and City attorney are working to complete this step <br />as of 11/15/19. While this is of lesser concern seeing as the City is owner of <br />the land currently, we will still see this step completed prior to Council <br />approval of the final PRD. <br />Based on these criteria, staff does find the final PLAT to be in substantial <br />compliance with subdivision requirements and preliminary approval. <br /> <br />PC Role at this <br />time: <br /> Section 7-090(6) reads: <br />“The Planning Commission shall indicate by recommendation to the City Council <br />that the final plan for planned residential development is in substantial compliance <br />with the preliminary plan and shall add any further conditions it deems necessary <br />to protect the public health, safety, morals, and general welfare. Any final plan <br />deemed not to be in substantial compliance with the preliminary plan or in <br />compliance with Chapter 26 of the City Code except as changed by variation noted <br />by the applicant shall be as noted in the recommendation to the City Council as to <br />exactly where the final plan is not in compliance and to what degree and shall <br />further recommend as to whether another public hearing is in order.” <br />
