Currently there are no <br />concrete plans to develop the property. The main purpose of this project at this time is to clean up legal <br />descriptions and any title issues. There a several legal descriptions which have ambiguities and omissions <br />that were creating overlaps within the property and overlaps with adjoining parcels. Over the last year the <br />Murlowskis, their attorneys and our surveying department have been working with the title company and <br />neighbors trying to resolve the overlap issues on the neighboring parcels. The internal overlaps will be <br />cleaned up through the platting process. The client and the client's attorney have done their due diligence to <br />address the overlaps with the adjoining parcels by attempting to exchange Quit Claim Deed to no avail. <br />Since we have not had any cooperation with the neighboring properties the clients have chosen to acquiesce <br />to the adjoining property descriptions. Since the property is abstract we have decided to rewrite the legal <br />description of the property as part of the final plat. As part of this process the overlap with the adjoining <br />parcels will go away. The title company and the Ramsey County Surveyor have been consulted, have review <br />the proposed legal description, and have agreed this is the best way to clean this up. <br />The clients are requesting a 2 lot final plat. Lot 1 would consist of the existing building owned by Murco Inc. <br />The boundary of Lot 1 will not differ from the current property description for that lot. Lot 2 would consist of <br />and combine the remnant parcels. <br />As part of this application we are requesting the City of New Brighton waive certain requirements until a final <br />development plan is prepared. Once this phase of the project is complete and the legal descriptions and title <br />is cleaned up we will address final easements, wetland, storm water, engineering, dedication, and other <br />issues as part of a final development plans.
