Murlowski Industrial Park Preliminary & Final Plat, SUP & Site Plan Amendment, and Variance
City Council Report; 4-28-20

Page 10
(cont.)  Engineering has reviewed the proposed alignment, and finds it to be acceptable.
 The potential area for the new road is being platted as an Outlot as no road will be
constructed at this time. The Outlot does preserve needed land for future road
connections in support of the concurrently proposed subdivision.
 NOTE: the current main access for the property is provided via a private roadway
on a 30’ strip of roadway easement across the northern lot line. The City intends
to maintain an interest in this 30’ easement until it is deemed to be unnecessary.
Should a new roadway be built through Outlot A as envisioned by this proposal, a
future Council could examine all facts at that time, and make a determination as to
whether the 30’ roadway easement was still necessary.

Storm Sewer
Systems:
 Per the City Engineer: “The preliminary plat indicates the existing 36” storm
sewer outlet from Rush Lake will be abandoned. If this is the case, further
information needs to be provided regarding the installation of new storm sewer to
provide an outlet from Rush Lake. A permanent drainage and utility easement
should also be shown over the storm sewer.”
 To clarify, the existing outlet will only be abandoned once it is replaced in a spot
and alignment agreed upon by all interested parties. In the meantime, this process
will formally establish an easement over the outlet and stormsewer pipe which can
be vacated in the future if no longer needed.
 All parties have come to agreement that upgrading of the existing storm sewer
outlet is best done concurrent with either new development of proposed Lot 1, or
when grant funding is secured for the improvement.
 At this time, staff is recommending the City require dedication of a formal
easement over the existing storm sewer to alleviate any disagreements on
prescriptive rights. As part of the plat, the applicants will dedicate a 40’ wide
easement centered upon the position of the storm pipe as built. If/when the lake
outlet is rebuilt and moved to a better location, this easement could be vacated.

Sound Wall:  To date, staff has not received any complaints regarding sound on the property, or
the effectiveness of the latest sound wall expansion in recent years. No changes
needed.

Storm water /
Grading /
Erosion:
 As the proposed changes will not result in the disturbance of any ground at the
present time, there is no need to amend or acquire a new NPDES or RCWD
permit.
