This section outlines the special authority given to the Building Official to <br />take immediate actions when an emergency state exists (i.e. hazards affecting the life/health/safety of either <br />tenants or neighboring properties). <br />• Lines 356 – 362. Posted to Prevent Occupancy. This section gives the Building Official the ability to prohibit <br />occupancy to a dwelling unit when it is found to be hazardous or unfit for human habitation. <br />• Lines 363 – 368. No Retaliation. This section makes it a code violation for landlords to take punitive actions <br />against any tenant who makes good faith complaints regarding their unit or building. Existing Section 13-165. <br />• Lines 369 – 371. Falsely Reporting Violations. This section covers the other side of the coin, and makes it a <br />code violation for tenants to make baseless accusations against their landlord. <br />• Lines 372 – 374. Violations. This section classifies violations of licensing standards as a misdemeanor, and <br />each day of violation would constitute a separate offense. <br />• Lines 375 – 378. Rules, Policies, and Procedures. While an earlier section provided the City Manager <br />authority to adopt policies on implementing this Article, this section is a second catch-all that allows Council to <br />take that authority upon themselves and adopted policies and rules via resolution. <br />• Lines 379 – 506. Provisional License – Three or More Units. These are the current provisional license <br />provisions in code with some reorganization for clarity where needed. <br />o Lines 380 – 421: Match Section 13-161(1) in the current code. <br />o Lines 422 – 426: New language stating what a licensee must do when they receive notice that provisional <br />status has been triggered. <br />o Lines 427 – 443: New language stating what must be submitted as part of a provisional license application. <br />o Lines 444 – 452: Revisions to current Section 13-161(4) to be more in-line with Council’s decision making <br />process used in other licensing matters. <br />o Lines 453 – 457: Rewording of Section 13-161(5) in the current code. <br />o Lines 458 – 464: Rewording of Section 13-162 in the current code. <br />o Lines 465 – 467: Match Section 13-163(2) in the current code. <br />o Lines 468 – 472: Rewording of Section 13-163(3) in the current code.
