Page 1 of 3 <br /> <br />RESOLUTION __________ <br />CITY COUNCIL <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT <br />AMENDMENT TO ALLOW CONSTRUCTION OF A NEW GARAGE ON THE GLOBAL <br />ACADEMY SITE AT 3000 5TH ST NW <br /> <br />WHEREAS, the City of New Brighton is a municipal corporation, organized and existing under the <br />laws of the State of Minnesota; and, <br /> <br />WHEREAS, the City Council of the City of the New Brighton has adopted a comprehensive plan <br />and corresponding zoning regulations to promote orderly development and utilization of land within <br />the city; and, <br /> <br />WHEREAS, Global Academy owns and operates a school on R-1 zoned property at 3000 5th St NW <br />which is legally described as: <br /> <br />Lot 2, Block 1, Seminary Estates 2nd Addition. <br /> <br />WHEREAS, Global Academy filed an application seeking to amend their special use permit and <br />site plan to authorize construction of a new garage to house groundskeeping equipment; and <br /> <br />WHEREAS, the garage will meet setback and height standards for an accessory structure in the R-1 <br />zoning district; and <br /> <br />WHEREAS, staff fully reviewed the requests and prepared a report for consideration by the <br />Planning Commission at their meeting on May 16, 2023; and <br /> <br />WHEREAS, the Planning Commission held a public hearing on the request at the May 16th meeting <br />and considered input from residents; and <br /> <br />WHEREAS, the Planning Commission recommended approval of the request on May 16th based on <br />the applicant’s submittals and findings of fact; and <br /> <br />WHEREAS, the City Council considered on May 23, 2023, the recommendations of the Planning <br />Commission, Staff, the Applicant's submissions, the contents of the staff report, and other evidence <br />available to the Council. <br /> <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of New Brighton <br />hereby approves the requested special use permit and site plan amendment based on the following <br />findings of fact:
