14 <br />with a disability under the ADA, defined as a person who has a physical or mental impairment that <br />substantially limits one or more major life activities, has a record of such impairment. A qualified <br />individual with a disability is someone who satisfies skill, experience, education, and other job- <br />related requirements of the position held or desired, who with or without reasonable accommodation, <br />can perform the essential functions of the position. Reasonable accommodations will be afforded to <br />a qualified individual, unless doing so would impose an undue hardship on the City of New Brighton. <br /> <br />Notice of Equal Opportunity Employer (EOE)EEO shall be included in each notice of opening. It is <br />the policy and intent of the City of New Brighton to provide equality of opportunity in employment to <br />all persons. <br /> <br />The City Manager or designee is responsible for overseeing the implementation of and <br />conformance to the requirements under the EOE EEO and the ADA. The City Manager or designee <br />is responsible for assuring that the practices and policies are effective and applied to everyone <br />uniformly. <br /> <br />Any employee involved in discriminatory practices will be subject to discipline, up to and including <br />termination. See Respectful Workplace Policy (Section 23). <br /> <br />1.7 ADA Grievance Procedure <br />If an applicant or program participantindividual believes that they were not treated fairly in regards <br />to the application of the Americans with Disabilities Act they may file a grievance through the <br />process listed below. The grievance procedure allows employees, applicants, or program <br />participants to appeal the decision or action taken by the City: <br />A. Individuals must submit the grievance in writing within ten business days of the incident to <br />their immediate supervisor or to the respective Department Director. <br />B. Within ten business days of receipt of the grievance, the supervisor and employee (or the <br />program participant and Department Director) will meet to discuss and resolve the program <br />with a mutually acceptable agreement. <br />C. If step B is unsuccessful, the employee and supervisor (of the program participant and <br />Department Director) within ten days of the meeting, will meet with the City Manager where a <br />final binding decision will be made. <br /> <br />1.8 City Council <br />The City Council consists of a Mayor and four City Council Members. Each is elected at large. <br />The Council meets on the second and fourth Tuesday of each month at 6:30 p.m. City Council <br />work sessions are held prior to a regular City Council meeting. The times for work session <br />meetings will vary, but are typically held at 5:00 p.m. Special meetings of the City Council will be <br />scheduled as necessary by the Mayor. <br /> <br />1.9 Committees and Commissions <br />1.9A Economic Development Authority <br />The New Brighton Economic Development Authority (EDA) was established in 1993. <br />Minnesota Statutes, Sections 469.090 through 469.108, authorizes cities to establish <br />Economic Development Authorities (EDA) with specified powers and obligations to promote <br />and to provide incentives for economic development. <br /> <br />1.9B Planning Commission
