22 <br />3.31 Drug <br />A controlled substance as defined by Minn. Stat. 152.01, Subd. 4, including all cannabinoids that <br />are lawfully available for public consumption and that do not otherwise qualify as being a “controlled <br />substance.” Cannabis and its metabolites are considered a “drug” for positions defined by Minn. <br />Stat. 181.951, Subd 9. <br /> <br />3.32 Drug and Alcohol Testing, Drug or Alcohol Testing, and Drug or Alcohol Test <br />Analysis of a body component sample according to the standards established under one of the <br />programs listed in Minn. Stat. 181.953, Subd 1, for the purpose of measuring presence or absence <br />of drugs, alcohol, or their metabolites in the sample tested. Excludes cannabis testing unless stated <br />otherwise. <br /> <br />3.33 Cannabis Testing <br />Mean analysis of a body component sample according to the standards established under one of <br />the programs listed in Minn. Stat. § 181.953, subd.1, for the purpose of measuring their presence or <br />absence of cannabis in the sample tested. <br /> <br />33.34 Initial Screening Test <br />A drug or alcohol test that uses a method of analysis under one of the programs listed in Minn. Stat. <br />181.953, Subd 1. <br /> <br />3.345 Confirmatory Test and Confirmatory Retest <br />A drug or alcohol test that uses a method of analysis allowed under one of the programs listed in <br />Minn. Stat. 181.953 Subd. 1. <br /> <br />3.356 Reasonable Suspicion <br />Forming a belief based on specific facts, observations, and rational inferences drawn from those <br />facts. <br /> <br />3.367 Positive Test Result <br />A finding of the presence of drugs, alcohol, cannabis, or their metabolites in the sample tested by a <br />confirmatory test in levels at or above the threshold detection levels contained in the standards of <br />one of the programs listed in Section 181.953, Subd. 1.
