March 12,2024 Page 3 of 6 <br /> remain in place provided conditions of the SUP were followed, that noise violations did not <br /> exceed agreed upon thresholds, and that no unlicensed sales of liquor would occur moving <br /> forward. Since October 2023, the establishment has unfortunately been documented violating <br /> their pledge to discontinue unlicensed liquor sales multiple times. There are currently five <br /> criminal charges pending against the business for these infractions. Staff reviewed the SUP <br /> conditions with the Council and offered a detailed history of operations for the Mirage Banquet <br /> Hall. It was noted the event center operated from 2011 to 2018 without concern. However, <br /> after 2018 there have been numerous noise complaints. She provided further details regarding <br /> the matter before the Council and recommended the revocation of the existing SUP for the <br /> Mirage Banquet Hall. <br /> Motion by Councilmember Allen, seconded by Councilmember Abdulle to open the <br /> Public Hearing. <br /> 5 Ayes,0 Nays-Motion Carried <br /> The Public Hearing was opened at 6:58 p.m. <br /> Bill Green,resident of trailer patio,explained there were nights he could not get to sleep because of the noise <br /> coming from the event center.He stated his wife had to get up for work at 6:00 a.m.for work.He indicated <br /> his only recourse was to call the cops.He stated he wanted this place shut down because they were not <br /> following the rules. <br /> Danny Dahms,675 4th Avenue,reported his parents live at 478 9th Avenue which was right behind the event <br /> center.He indicated his mother was very concerned about the noise.He discussed how the noise from the <br /> event center was spilling out to the adjacent homes,especially when the doors were open. He commented on <br /> how the grounds were filled with trash and noted the property was not mowed once last year. He asked that <br /> the Council take action on order to stop the event center operations. <br /> Pat Rother,490 9th Avenue NW,stated he was the twin brother of Pedro Rother.He explained he was <br /> concerned with what has been going on at the Mirage since 2018 and more recently in 2021.He reported the <br /> new information from staff was very revealing.He indicated he was concerned about the activity that was <br /> occurring.He commented on how the bass from the event center was heard throughout the neighborhood. <br /> He recommended a more concerted decision regarding this property,especially those who have been given a <br /> second chance and were still not conforming to City requirements.He stated he wanted to see some <br /> accountability because he had complaint fatigue. <br /> Foley Cooker,part owner of Mirage Banquet Hall,discussed how he had worked to address the concerns of <br /> the City that were raised in 2021.He explained Mirage is a banquet hall and he does his best to inform the <br /> renters to be on the same page.He indicated he tries to ensure the noise does not go out into the neighborhood <br /> and that the rules are being followed.He stated he has never heard about the display license until October of <br /> 2023 when the City brought in people from St Paul with the alcohol department He indicated he was not <br /> aware that he needed a security plan.He reported he only recently learned that he was not in compliance,after <br /> speaking with Bridget,that the people selling liquor on the premises do not have the required license to serve. <br /> He explained when he learned this information he acquired three different vendors that have proper licensing. <br /> He indicated he was not in the process to sell alcohol,but rather the banquet hall was used for birthday parties <br /> and weddings.He requested he be allowed to get back in the community because he has invested a great deal <br /> of money in the site.He stated his intention was not to be a nuisance in the community,but rather he wanted <br /> to see a return on his investment.He commented on how the landlord has not been helpful and he was having <br /> to hire someone to mow the property. <br /> Gregory Pedro Amusu explained he has been a resident ofNew Brighton for the past 40 years.He stated <br /> when the event space was open,he brought in a partner to see how to address the concerns.He commented <br /> on how events are planned and stated alcohol was not to be sold in the space.He reported when the <br /> Department of Alcohol came to the space,he showed Bridget the certificates he has in place.He was <br /> informed by Bridget to only use Caterers licensed to provide alcohol.
