He indicated he was at this event to ensure no alcohol was sold,only food. <br /> He reported he was then told he needed a consumption permit.He commented further on the process he tried <br /> to follow to bring the banquet hall into compliance. <br /> Mayor Niedfeldt-Thomas asked for additional comments, there were none. <br /> Motion by Councilmember Dunsworth, seconded by Councilmember Abdulle to close the <br /> Public Hearing. <br /> 5 Ayes,0 Nays-Motion Carried <br /> The Public Hearing was closed at 7:12 p.m. <br /> Mayor Niedfeldt-Thomas thanked all the members of the public who spoke at the public hearing. <br /> Councilmember Allen asked if there was anything public safety would like to add to the presentation.Deputy <br /> Public Safety Director Hamdorf reported the presentation from staff was very thorough and he had nothing to <br /> add at this time. <br /> Councilmember Allen explained he lives near the banquet hall.He indicated the noise was constant from this <br /> property.He agreed that the bass was a concern and could be heard from blocks away.He stated if he was on <br /> the Council in 2011,he would have voted against the request for a banquet hall on this property.He reported <br /> this property does not have the infrastructure in place to support the sound and noise coming from the site, <br /> especially given the hours of operation.He indicated he had complaint fatigue,as do many of his neighbors. <br /> While he appreciated the fact these gentleman were trying to run a business,it was not the City's <br /> 11 responsibility to tell these gentleman how to operate their business.He did not believe this property should be <br /> allowed to operate as it does. <br /> Councilmember Dunsworth agreed this building should not operate as a banquet hall.She explained the <br /> Council was reviewing this matter because the business owners have a flagrant disregard for the law.She <br /> indicated the City allowed them a pass in 2021 and the business owners have been unable to bring the <br /> property into compliance with City Code.She stated while the noise may be out of their control,the liquor <br /> sales was not and the business owners were not abiding by local and State law.She believed the Council has <br /> heard only excuses tonight and there has been no accountability for the actions of the business owners.She <br /> reported a great deal of public safety time has been spent on this property and she supported the SUP being <br /> revoked. <br /> Mayor Niedfeldt-Thomas commented in her career she has done a lot of coaching and supporting of <br /> entrepreneurs. She stated she understood how important small business ownership was and she wanted <br /> people to success. However,she did not believe this space was right for how it was being used.She discussed <br /> how clear the Council was in 2021 on how the site was to be used and that this property was not to be a night <br /> club.She stated it has become obvious to the City that for many reasons this space turns into a night club.She <br /> explained the Council was elected to make sure rules are followed and to ensure people are safe.She noted <br /> one of the Council's priorities was to create a livable community and she was concerned that this space was <br /> not aligning with this priority. She thanked the City staffteam for keeping the Council apprised of the <br /> situations that have occurred on this property. She explained the Council wants to support small businesses, <br /> but also has to listen to concerns.She further discussed how the rules laid out by the Council in 2021 have not <br /> worked out and this time she would support the SUP being revoked. <br /> Motion by Councilmember Allen,seconded by Councilmember Axberg to adopt a Resolution to <br /> revoke the existing SUP which authorizes the Mirage Banquet Hall to operate out of the <br /> building at 400 Old Highway 8. <br /> 5 Ayes,0 Nays-Motion Carried <br />
