Teague suggested ~ code amendment to the B-3 District which would restrict <br />hours of operation if the use is within a certain proximity of residential uses. <br /> <br />Moore-Sykes confirmed this current use would be grandfathered, and if the business were <br />destroyed, the owner could not be rebuild at the current R-2 standards. <br /> <br />Motion by Samuelson, seconded by Hoffman, to WAIVE THE READINGS AND <br />ADOPT THE ORDINANCE REZONING 2251 LONG LAKE ROAD FROM R-2, <br />TWO F AMIL Y RESIDENTIAL TO B-3, GENERAL BUSINESS. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />In regards to the Accessory Structures petition, Larson explained that staff will be directed <br />to perform a thorough review of zoning and ordinances, and present these tindings to <br />Council at an upcoming meeting. A resident asked if a task force will be assembled to <br />study the issue. Samuelson explained that creation of a task force could be a future <br />consideration. One resident feels that input from the community is important. Larson <br />agreed, and resident concems will be taken into consideration. Residents should contact <br />Teague with their comments. <br /> <br />Teague presented a special use permit to construct a 6 ft. privacy fence in the frontyard of <br />744 22nd Ave. Access to the home is off a private driveway over platted 30 ft. unimproved <br />right-of-way (ROW) easement that extends to the west. The Planning Commission <br />recommended approval. <br /> <br />Scott Sanville, 744 22nd Ave NW, said the fencing would be located along the west side of <br />the driveway to the back lot line and connect to existing fencing and landscaping. Teague <br />said both property owners have been extremely patient and the outcome is amicable. <br /> <br />Motion by Hoffman, seconded by Moore-Sykes, to WAIVE THE READING AND <br />ADOPT THE ATTACHED RESOLUTION RECOMMENDING APPROVAL OF <br />SPOO-I0 SUBJECT TO THE FOLLOWING CONDITION: <br /> <br />1. <br /> <br />APPLICANT MAY CONSTRUCT 6 FT. TALL WOOD FENCE ON THE <br />NORTH SIDE OF EXISTING DRIVEWAY WITHIN THE UNIMPROVED <br />RIGHT-OF-WAY. <br />THE FRAMING MATERIAL OF THE FENCE SHALL BE PLACED ON <br />THE APPLICANT'S SIDE OF THE FENCE. <br />IN THE EVENT THE CITY REQUIRES REMOVAL OF THE FENCE IN <br />THE FUTURE FOR ANY PURPOSE RELATED TO DEDICATION OF <br />RIGHT-OF-WAY FOR STREET AND RELATED PURPOSES, THE LAND <br />OWNER SHALL REMOVE THE FENCE AT NO COST TO THE CITY. <br />CITY DOES NOT REPRESENT OR WARRANT AND MAKES NO <br />FINDINGS THE APPLICANT HAS ANY LEGAL RIGHTS IN THE LAND <br />ON WHICH APPLICANTS PROPOSE TO CONSTRUCT THE FENCE. <br />FENCE SHALL NOT BE CLOSER TO 22ND AVE.
