He feels this building will be a pleasing addition, and will try to accommodate the relocation of larger trees. Tom Bannigan, Chenoweth attorney, said the Chenoweths have much concern that their business will not survive the continued redevelopment of this area. Being with the nature of their business, the lack of sunlight is very critical to 80% of their trade. He asked the City to enter into discussions for the future acquisition of the Chenoweth property. Benke acknowledged there was never a firm commitment of participation from the Chenoweths, however, he directed staff to research the possibility of acquisition. Vicki Chenoweth noted continued concerns with fencing, noise levels, and vandalism. Benke reiterated that the City will continue to develop a long term solution. Motion by Hoffman, seconded by Larson, to APPROVE LP-349, SUBJECT TO THE FOLLOWING CONDITIONS: 1. CONTINUING COMPLIANCE WITH RICE CREEK WATERSHED DISTRICT PERMIT 96-72. 2. THE DRIVEWAY ENTRANCE OFF OF OLD HIGHWAY 8 SHALL BE SUBJECT TO APPROVAL OF RAMSEY COUNTY. 3. PERIMETER CURBING MUST BE INSTALLED AROUND THE OFF- STREET PARKING AREA. 4, THE SITE MUST BE DEVELOPED PER THE APPROVED SITE PLAN DATED DECEMBER 23, 1998, INCLUDING THE 120 OFF -STREET PARKING STALLS. 5. ALL OFF-STREET PARKING AND DRIVE AREAS BE PAVED WITH BITUMINOUS SURFACE. 6. ALL OFF STREET PARKING STALLS SHALL BE MARKED WITH WHITE OR YELLOW PAINTED LINES NOT LESS THAN FOUR (4) INCHES WIDE. 7. ALL LANDSCAPING SHALL BE INSTALLED PER THE APPROVED LANDSCAPE PLAN, WITH EXCEPTION THAT THE GREEN SPIRE LINDEN LOCATED ON THE SOUTH SIDE OF THE DRIVE ENTRANCE TO CAMPUS DRIVE BE MOVED TO THE WEST SO NOT TO OBSTRUCT SITE DISTANCES FOR CARS AND TRUCK EXITING ONTO CAMPUS DRIVE. ADDITIONALLY, THE WESTERN MOST PINK SPIRE CRAB AND COLORADO SPRUCE (2 TREES TOTAL), ADJACENT TO THE CHENOWETH PROPERTY, BE ELIMINATED FROM THE PLAN TO PROTECT VIEWS OF THE CHENOWETH SIGN. 8. A FIRE HYDRANT BE INSTALLED ON THE NORTH SIDE OF THE ENTRANCE OFF OF OLD HIGHWAY 8, AND THE Y CONNECTION ON THE BUILDING BE LOCATED IN THE NORTHEAST CORNER. 9. THE PROPOSED GRADING PLAN SHALL BE SUBJECT TO REVIEW AND APPROVAL OF THE CITY ENGINEER. 10. SECURITY LIGHTING SHALL BE INSTALLED PER THE LIGHTING PLAN DATED DECEMBER 23,1998, AND SO THAT NO DIRECT LIGHT IS DETECT ABLE FROM ANY LOT LINE ON THE SITE. 5 Ayes - 0 Nayes, Motion Carried.
