He feels this building <br />will be a pleasing addition, and will try to accommodate the relocation of larger trees. <br /> <br />Tom Bannigan, Chenoweth attorney, said the Chenoweths have much concern that their <br />business will not survive the continued redevelopment of this area. Being with the nature <br />of their business, the lack of sunlight is very critical to 80% of their trade. He asked the <br />City to enter into discussions for the future acquisition of the Chenoweth property. <br />Benke acknowledged there was never a firm commitment of participation from the <br />Chenoweths, however, he directed staff to research the possibility of acquisition. <br /> <br />Vicki Chenoweth noted continued concerns with fencing, noise levels, and vandalism. <br />Benke reiterated that the City will continue to develop a long term solution. <br /> <br />Motion by Hoffman, seconded by Larson, to APPROVE LP-349, SUBJECT TO THE <br />FOLLOWING CONDITIONS: <br />1. CONTINUING COMPLIANCE WITH RICE CREEK WATERSHED <br />DISTRICT PERMIT 96-72. <br />2. THE DRIVEWAY ENTRANCE OFF OF OLD HIGHWAY 8 SHALL BE <br />SUBJECT TO APPROVAL OF RAMSEY COUNTY. <br />3. PERIMETER CURBING MUST BE INSTALLED AROUND THE OFF- <br />STREET PARKING AREA. <br />4, THE SITE MUST BE DEVELOPED PER THE APPROVED SITE PLAN <br />DATED DECEMBER 23, 1998, INCLUDING THE 120 OFF -STREET <br />PARKING STALLS. <br />5. ALL OFF-STREET PARKING AND DRIVE AREAS BE PAVED WITH <br />BITUMINOUS SURFACE. <br />6. ALL OFF STREET PARKING STALLS SHALL BE MARKED WITH <br />WHITE OR YELLOW PAINTED LINES NOT LESS THAN FOUR (4) <br />INCHES WIDE. <br />7. ALL LANDSCAPING SHALL BE INSTALLED PER THE APPROVED <br />LANDSCAPE PLAN, WITH EXCEPTION THAT THE GREEN SPIRE <br />LINDEN LOCATED ON THE SOUTH SIDE OF THE DRIVE ENTRANCE <br />TO CAMPUS DRIVE BE MOVED TO THE WEST SO NOT TO <br />OBSTRUCT SITE DISTANCES FOR CARS AND TRUCK EXITING ONTO <br />CAMPUS DRIVE. ADDITIONALLY, THE WESTERN MOST PINK <br />SPIRE CRAB AND COLORADO SPRUCE (2 TREES TOTAL), <br />ADJACENT TO THE CHENOWETH PROPERTY, BE ELIMINATED <br />FROM THE PLAN TO PROTECT VIEWS OF THE CHENOWETH SIGN. <br />8. A FIRE HYDRANT BE INSTALLED ON THE NORTH SIDE OF THE <br />ENTRANCE OFF OF OLD HIGHWAY 8, AND THE Y CONNECTION ON <br />THE BUILDING BE LOCATED IN THE NORTHEAST CORNER. <br />9. THE PROPOSED GRADING PLAN SHALL BE SUBJECT TO REVIEW <br />AND APPROVAL OF THE CITY ENGINEER. <br />10.
