Concerns have been raised by staff, <br />Planning Commission, and Council that the existing regulations for truck terminals, <br />truck yards, truck and trailer repair and outside storage is not specifically regulated. <br /> <br />Staff believes a truck terminal or yard does not fit the 1-1, and should only be allowed by <br />SUP in the 1-2 District. The Planning Commission tabled action on the regulation for <br />outside storage, and will further analyze in March. Staff recommends that Truck and <br />Trailer repair not be allowed within the 1-1, and allowed by SUP in the 1-2 District. <br /> <br />Larson suggested the term "oleomargarine" in Section 6-130, Permitted Uses, 1-2 <br />District, be changed to a more correct term of "margarine." Teague will make that <br />change and bring back to Council on March 9, 1999. <br /> <br />Motion by Gunderman, seconded by Hoffman, to WAIVE THE FIRST AND <br />SECOND READINGS AND ADOPT THE ORDINANCE AMENDING CERTAIN <br />SECTIONS OF CHAPTER VI REGARDING INDUSTRIAL ZONING <br />DISTRICTS. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Teague presented a minor subdivision request from Richard Brickner to divide the <br />existing vacant property located south of 1248 12th Ave. NW and north of 1230 12th <br />Ave. NW into two lots. Both lots would meet minimum lot size and width requirements. <br />Because of grading concerns, staff added a condition of approval that the grading plan <br />must be submitted with any building permit application to show grades and drainage <br />patterns to ensure no negative impacts on adjacent properties. No public comment has <br />been received regarding this proposal. <br /> <br />Motion by Gunderman, seconded by Hoffman, to WAIVE THE READING AND <br />ADOPT THE RESOLUTION APPROVING PL-249 SUBJECT TO THE <br />FOLLOWING CONDITIONS: <br />1. GRADING AND DRAINAGE PLAN MUST BE SUBMITTED WITH A <br />BUILDING PERMIT APPLICATION TO ENSURE GRADING <br />ASSOCIA TED WITH CONSTRUCTION OF THE TWO HOMES SHALL <br />NOT HAVE NEGATIVE IMPACT ON ADJACENT PROPERTIES. <br />2. PER SECTION 26-27 OF THE NEW BRIGHTON CITY CODE, THE <br />APPLICANT WILL BE REQUIRED TO DEDICATE $750 PER LOT <br />(TWO NEW LOTS) FOR PARK PURPOSES. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Teague presented a site plan review and special use permit to tear down the existing <br />Tank-n-Tummy, 201 Co. Rd. E-2, and construct a new convenience store/gas facility <br />with car wash, canopy and office space. The applicant, Hiawatha Oil, is requesting to <br />reduce the setback on the east property line facing 1-35W from the required 30 ft. <br />setback to 15 ft.
