The truck yard could be eliminated as an allowable use, and <br />outside storage could be regulated by a special use permit requiring landscaping and <br />assurance no negative impact to adjacent properties. The special use permit could limit <br />outside storage to 20 % of the gross floor area of the facility. Staff recommends <br />development of an amendment to regulate trucking and outdoor storage. <br /> <br />Motion by Gunderman, seconded by Samuelson, to AUTHORIZE STAFF AND THE <br />PLANNING COMMISSION TO PREPARE A ZONING ORDINANCE <br />AMENDMENT TO INCLUDE THE FOLLOWING: EXAMINE THE <br />APPROPRIATE REGULATIONS FOR "TRUCK TERMINALS OR YARDS" <br />WITHIN THE 1-1, LIGHT INDUSTRIAL AND 1-2, HEAVY INDUSTRIAL <br />ZONING DISTRICTS; TO SPECIFICALLY ALLOW TRUCK AND TRAILER <br />REPAIR AND SALES AS A SPECIAL USE ONLY WITHIN THE 1-2, HEAVY <br />INDUSTRIAL ZONING DISTRICT; TO PLACE SPECIFIC REGULATIONS ON <br />OUTSIDE STORAGE IN THE 1-1, LIGHT INDUSTRIAL ZONING DISTRICT. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Teague presented ordinance amendments to create a new MX-G, Mixed Use-Gasoline <br />Zoning District; and amend the B-3 Zoning District to allow gasoline sales as a Special <br />Use rather than permitted use. As part of the rezoning and creation of the MX, Mixed <br />Use District, Council directed staff and Planning Commission to investigate permitting of <br />gas sales at the northwest corner of Hwy 96 and Old Hwy 8. Teague presented the <br />following four alternatives: <br /> <br />A. Amend the MX District to allow gas sales by Special Use Permit. Conditions <br />would include installation of pedestrian linkages, complementary buildings, and <br />landscaping. Gas sales would be limited to the two corner parcels located north <br />and south of the Old Hwy 8/Hwy 96 intersection. The problem with this scenario <br />is the property was envisioned to be developed as a multi-story oftlce complex. <br /> <br />B. Rezone the property to B-3, General Business, to allow gas sales as a permitted <br />use. Staff has some concerns that if the property was rezoned, an owner would <br />have the ability to change the use to a type incompatible with the Vision. <br /> <br />C. React to a specific proposal from the property owner. The City would have the <br />opportunity to react to a proposal rather than anticipate a developer's plans. If <br />the site was rezoned to B-3, the development could be held to MX standards. <br />Staff and Planning Commission have reservations over rezoning to B-3 because <br />other uses would also be allowed. <br /> <br />D. <br /> <br />Create a new zoning district (MX-G, Mixed Use Gasoline). The MX-G would be <br />identical to MX with the exception that gas sales would be allowed by special use <br />permit, and all standards would be followed. Gas sales could not be limited to <br />certain areas or properties containing access off two arterial roadways. <br /> <br />Staff and Planning Commission recommend Option D, and an ordinance amendment to <br />allow gas sales within the B-3 as an allowed use by special use permit.
