In addition, DeCoster wishes <br />to purchase two parcels to the north and east to construct an office building. The <br />Planning Commission has concern with the canopy's visibility being this intersection is a <br />"Gateway" into New Brighton. It is suggested the canopy be limited to the rear yard, the <br />building be constructed of brick with pitched roof, and contain limited signage. <br /> <br />Benke confirmed the property lines take in consideration the adjustments to accommodate <br />the Hwy 96 widening. <br /> <br />Doug DeCoster favors the amendment, and believes locating the canopy to the rear may <br />create logistics problems with the proposed office building to the north. <br /> <br />Motion by Hoffman, seconded by Samuelson, to AUTHORIZE STAFF TO DRAFT A <br />ZONING ORDINANCE AMENDMENT TO CREATE AN MX-G, MIXED USE <br />GASOLINE ZONING DISTRICT, IN WHICH GASOLINE SALES IS A USE <br />ALLOWED BY A SPECIAL USE PERMIT, AND DRAFT AN ORDINANCE <br />AMENDMENT TO REQUIRE A SPECIAL USER PERMIT FOR GASOLINE <br />SALES WITHIN THE B-3, ZONING DISTRICT. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Teague presented the rezoning of the U.S. Filter/Johnson Screen property (northwest <br />corner of Hwy 96 and Old Hwy 8) from 1-2, Heavy Industrial to MX, Mixed Use. This <br />parcel was not part of the MX rezoning process due to further consideration by the <br />Planning Commission. U. S. Filter would like the potential to utilize this vacant parcel <br />for possible expansion of their existing facility. Teague noted that U.S. Filter's <br />fabrication production process is not a use allowed within the MX District. The Planning <br />Commission considered the following options: <br /> <br />A. Amend the MX District to allow fabrication as a special use under certain <br />conditions. Included would be specific requirements such as pedestrian linkages, <br />complimentary buildings, landscaping, limitations of noise and dust, and hours of <br />operations. Staff noted concern in allowing fabrication as an allowed use in the <br />MX District. Also, this site is considered a "Gateway," and development <br />proposals should involve careful considerations. <br /> <br />B. Leave the current zoning as 1-2, Heavy Industrial. If the property remained at 1- <br />2, the owner could utilize the site or sell it to another heavy industrial user. The <br />Hwy 8 Vision Plan does not state Heavy Industrial as a designated use. The <br />Planning Commission feels this site is best suited for either a U.S. Filter <br />expansion or office usage, and was comfortable with leaving the 1-2 designation. <br /> <br />c. <br /> <br />Rezone the site to MX, and react to specific proposals from property owners. In <br />this case, the Planning Commission and Council would have opportunity to <br />participate in the development of an expansion rather than anticipating a <br />developer's ideas. U.S. Filter may be agreeable if writing states the City would <br />seriously consider rezoning the site to 1-2 and allowing future expansion.
