Teague confirmed that staff could work <br />with AAA to develop the site and landscape plans, and address the non-conformities. <br />The Planning Commission would make recommendations on February 23, 1999. If <br />agreement is not reached, an amendment to the ordinance would be required. <br /> <br />LeFevere added that if Council preferred more information or if AAA requested a delay, <br />a final decision could be made at a subsequent meeting. Depending on Council wishes, <br />statements referring to special treatment for certain non-conformities within a MX <br />District could be added. <br /> <br />Larson noted concern that the number of fueling bays seems to change. Benke feels the <br />proposed recommendation would allow ample time to review the site plan to give <br />Council a better idea of the AAA proposal. <br /> <br />Community Development Director Kevin Locke feels there could be a method to allow <br />interim fueling on-site, and believes Plalming Commission input will be of great value. <br /> <br />Larson added that any Council approved site plan between January 1, 1985 and the <br />ordinance's effective date for property in this area must be completed by January 1, <br />2005. <br /> <br />Motion by Gunderman, seconded by Samuelson, to AUTHORIZE STAFF TO DRAFT <br />AN ORDINANCE REZONING THE SUBJECT PROPERTIES FROM B-3 <br />(GENERAL BUSINESS), 1-1 (LIGHT INDUSTRIAL), 1-2 (HEAVY <br />INDUSTRIAL), AND 1-3 (LIMITED INDUSTRIAL) TO MX (MIXED USE) FOR <br />APPROVAL AT THE JANUARY 7,1999, COUNCIL MEETING WITH THE <br />EXEMPTION OF THE U.S. FILTER SITE (1950 OLD HIGHWAY 8) AND THE <br />BEBET REALTY SITE (50 14TH STREET NW); AUTHORIZE STAFF TO <br />DRAFT AL TERNA TIVE ORDINANCES RELATIVE TO THE REZONING OF <br />THE BEBET REALTY SITE; AUTHORIZE STAFF TO DEVELOP <br />AL TERNA TIVE ZONING OPTIONS FOR THE DECOSTER SITE (1823 OLD <br />HIGHWAY 8) TO ALLOW GASOLINE SALES. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Teague presented an ordinance amendment to allow flexibility in the requirement for <br />perimeter setbacks for Planned Residential Development (PRD) and Planned Unit <br />Development (PUD). This amendment is an implementation tool of the Vision which <br />calls for buildings to be located closer to streets, improved streetscapes with pedestrian <br />walkways in front of buildings, and parking provided on the street and behind buildings. <br /> <br />Current PRO regulations state there shall be a minimum setback of the height of the <br />building or 25 ft., whichever is less, from all properties lines which form the perimeter <br />of the PRD.
