Rd. On
May 19, the water service began leaking and needed repair. City policy states it is the
property owner's responsibility for repair and maintenance. The repair cost was $850,
and the owner stated it would be a financial hardship for them. Staff proposed that the
costs be special assessed to allow the owner to repay the City over a 10 year period.

There were no comments from the audience.

Motion by Gunderman, seconded by Samuelson, to CLOSE PUBLIC HEARING.

5 Ayes - 0 Nayes, Motion Carried.

Motion by Hoffman, seconded by Larson, to WAIVE THE READING AND ADOPT
THE RESOLUTION APPROVING SPECIAL ASSESSMENTS FOR PROJECT 98-
6, LAPORTE WATER SERVICE REPAIR.

5 Ayes - 0 Nayes, Motion Carried.

Project 98-7 involved the construction of a modular block retaining wall on 5th Ave.
along the New Brighton Care Center site. The wall was not necessary when the
reconstruction began, however, the Center's addition required grade changes which
resulted in a need for the wall. The project cost was $9,900.48, and because both the
City and the Center benefitted, the cost would be evenly split. It is proposed that the
Center be special assessed in the amount of $4,950.24 over a ten year period. Proper
confirmed the owners signed a waiver and are aware of the assessment.

There were no comments from the audience.

Motion by Larson, seconded by Samuelson, to CLOSE THE PUBLIC HEARING.

5 Ayes - 0 Nayes, Motion Carried.

Motion by Samuelson, seconded by Hoffman, to WAIVE THE READING AND
ADOPT THE RESOLUTION APPROVING SPECIAL ASSESSMENTS FOR
PROJECT 98-7, NORTH CITIES HEALTH CARE RETAINING WALL.

5 Ayes - 0 Nayes, Motion Carried.

Public Hearing

Special Assessments
for Projects 97-1, 98-
6, 98-7
Report 98-184
Resolution 98-086
Resolution 98-087
Resolution 98-088
Resolution 98-089
Resolution 98-090
Resolution 98-091
