<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />September 22, 1998 <br /> <br />Page 4 <br /> <br />Public Hearing <br /> <br />Police Chief John Kelley presented the request for an on-sale wine license and non- <br />intoxicating malt liquor application for Barley John's Brewpub, 781 Old Hwy 8. John L. <br />Moore and Laura J. Subak plan to operate a place which sells beer and case wine on- <br />sale. Under City Code, if you sold a wine license and a non-intoxicating malt liquor <br />license or 3.2 beer license, you may also receive at no extra fee a license for intoxicating <br />malt liquor. A public notice has been published on this application. <br /> <br />Moore and Subak noted their lengthy experience in the food service industry, and their <br />plans to brew beer on the premises. <br /> <br />Samuelson asked if any building modifications will be made. Moore explained they will <br />eliminate the existing "Chinese restaurant exterior" and make modifications to the <br />exterior and interior. City Planner Cary Teague confirmed that the renovation would <br />involve only changes to the existing structure which does not require a site plan review. <br /> <br />Hoffman asked if a market analysis was conducted in regards to this usage. Moore <br />preformed extensive demographic studies as it relates to New Brighton and surrounding <br />communities and found the brewpub usage would fit very well into their projections. <br /> <br />There were no comments from the audience. <br /> <br />Motion by Gunderman, seconded by Samuelson, to CLOSE THE PUBLIC HEARING. <br /> <br />5 Ayes ~ 0 Nayes, Motion Carried. <br /> <br />Council Business <br /> <br />City Attorney Charles LeFevere presented an amendment to the City Code for Sections <br />4-72 and 4-108 to allow brewers to sell their product at retail with an on-sale license. <br />The current code which prohibits this activity is based on a 1973 State law which has <br />been changed to permit such sales at brewpubs. LeFevere recommends the code <br />conform to State law to allow manufactures like brewpubs to sell retail on-sale. <br /> <br />Benke confirmed that within State law there is a definition relating to brewpubs. <br />LeFevere stated that the State law prohibits most manufacturers, but allows an <br />acceptance for brewpubs. The City is simply allowing State law control of this area as a <br />local requirement. <br /> <br />Motion by Gunderman, seconded by Hoffman, to HOLD AND WAIVE THE FIRST <br />AND SECOND READINGS OF AN AMENDMENT TO CHAPTER 4, ARTICLE <br />IV, DIVISION 2, SECTION 4-72, AND CHAPTER 4, ARTICLE V, DIVISION 2, <br />SECTION 4-108 (PERSONS INELIGIBLE {TO POSSESS NON-INTOXICATING <br />MALT LIQUOR AND ON-SALE INTOXICATING LIQUOR LICENSES}). <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Kelley presented an application for an on-sale wine and non-intoxicating malt liquor <br />license for Barley John's Brewpub.
