AND TO AMEND THE 1998 CITY <br />BUDGET FOR PREPARATION OF THE CITY'S COMPREHENSIVE PLAN TO <br />THE AMOUNT OF $66,300. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Teague presented a request for site plan review and sideyard setback variance for the <br />demolition and reconstruction of a new facility and canopy for PDQ, 940 W. Co. Rd. D. <br />The canopy and building meet minimum setback requirements, but the variance relates <br />to a 25 ft. green space sideyard setback. The property abuts an apartment complex, and <br />PDQ gains access off Co. Rd. D over a westerly easement. PDQ is unable to provide <br />the necessary setback due to the property line located in the middle of the drive aisle and <br />gas pumps. PDQ has an easement over this area to maintain access into their site. <br /> <br />Benke asked if the easement meets the required setback. Teague said a 5 ft. expansion is <br />needed to meet the 30 ft. setback requirement, and PDQ plans to landscape a portion <br />currently owned by the apartment complex. PDQ is in negotiations to purchase the <br />property which in all likelihood would provide for the setback requirement. <br /> <br />Staff and Planning Commission felt the unique hardship relates to the property line <br />location. If the City were to deny the variance, PDQ would need to significantly reduce <br />the size of the facility and remove a gas pump island. Staff and Planning Commission <br />both recommend approval of the variance request. <br /> <br />Randy Manning, PDQ, confirmed that the proposal involves four gas pumps. <br /> <br />Teague said originally, PDQ proposed a larger store with a car wash, however, this did <br />not meet setback requirements. The final proposal significantly reduces the size of the <br />store and meets the setbacks on the north, east, and south. <br /> <br />Samuelson verified the driveways will remain in their current locations, and asked if the <br />relocation of the pumps would increase the amount of traffic entering from Co. Rd. D. <br />Teague agrees there could be more customers entering the store from Co. Rd. D. <br /> <br />Benke said it appears the setback requirements relate to the need to lease additional land <br />and the sideyard landscaping issue. <br /> <br />Hoffman asked if the Police satellite office will remain at this location. Manning said <br />the plan includes an area where the police will have a desk and phone. <br /> <br />LeFevere said the hardship appears primarily due to a small site, but the project seems <br />beneficial to the neighborhood. Fulton added that the unique circumstance relates to the <br />easement which is a legal access. Manning added that numerous site plans were <br />considered, but a preference was made to retain the green spaces on Co. Rd.
