<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />June 23, 1998 <br /> <br />Page 4 <br /> <br />Council Business. continued <br /> <br />City Planner Cary Teague presented a preliminary plat to develop nine single family <br />homes on the north side of Stony Lake, east of Silver Lk. Rd. and west of 23rd Ave. <br />The site involves three wetlands: Stony Lake (not a water body, but DNR protected <br />wetland); a wetland on Lots 2 and 3 to be filled; and a wetland on Lot 1 which a portion <br />will be filled. Type 1,2, and 6 Wetlands may be filled without mitigation under DNR <br />and Rice Creek Watershed District (RCWD) rules, and this proposal involves those <br />wetland types. Review of the grading and wetland filling plan is subject to DNR and <br />RCWD review. The property is zoned R-l, Single Family Residential, and the proposal <br />is consistent with the Comprehensive Plan and Zoning Ordinance. <br /> <br />The garage portions of Lots 7, 8, and 9 do not meet the 30 ft. front setback, however, <br />these will be realigned to meet requirements. Lot 6 does not meet the 75 ft. minimum <br />lot width requirement and requires a variance. The Planning Commission recommended <br />that if the variance was approved, Lot 9 would be shifted to the west to save a large <br />group of trees. Staff does not feel Lot 6 contains an unique circumstance to justify the <br />variance. It was suggested that the applicant eliminate one lot or reconfigure another so <br />that the width requirement is secured. The City Forester suggested the White Oaks on <br />Lots 9 and 4 be preserved. A tree identification plan is being completed to assist in the <br />construction phase. <br /> <br />A public road is proposed off 23rd St. and there is an existing 60 ft. wide easement for <br />road purposes. The name of this cul-de-sac would be 16th Terrace. The street would be <br />constructed 32 ft. wide with a cul-de-sac radius of 42 ft. In 1992, a traffic study was <br />performed which found 205 daily vehicle trips on 23rd Ave., and 732 daily trips on 17th <br />St. These nine homes would likely generate a maximum of 90 additional daily trips. <br /> <br />The grading plan indicates drainage will flow away from existing homes and toward <br />Stony Lake. The City Engineer suggested installation of a six-inch overflow pipe from <br />the wetland to the catch basin to ensure stormwater flows southwest. A drainage and <br />utility easement would be placed over Stony Lake to ensure wetland protection. A <br />stormwater overflow will be installed at 23rd Ave. to maintain the level of Stony Lake. <br /> <br />The Comprehensive Plan does not designate this area as a future park site. It is <br />recommended the Park Dedication contribution be paid in cash in lieu of a land <br />contribution. Staff recommends a sidewalk/trail connection from the cul-de-sac to Silver <br />Lk. Rd. to provide access to the sidewalk. <br /> <br />Teague summarized the conditions of the approval: <br /> <br />1. <br />2. <br /> <br />Approval of a permit by the Rice Creek Watershed District (RCWD). <br />The proposed roadway must be constructed to full City standards, a 32-foot wide <br />paved surface with a 42-foot paved radius for the cul-de-sac. <br />Submittal of Tree Identification Plan as part of Final Plat application, and <br />reaching an agreement with City Forester as to what significant trees (8-inch <br />diameter) will be removed and what significant trees remain. Said plan must <br />include what tree protection measures that would be utilized during construction. <br />The mature White Oaks along the eastern lot line are not disturbed, and a <br />minimum setback for driveways and all structures be 30 feet from the east <br />property line for Lot 9. <br /> <br />3. <br /> <br />4. <br /> <br />Council Business <br /> <br />Preliminary Plat and <br />Variance for Stony <br />Lake Development <br />Report 98-133 <br />
