Motion carried, <br /> <br />Benke thanked Council, Staff, and developer for the time they have invested in bringing <br />this project to an acceptable development proposal. He noted that the Rice Creek Center <br />redevelopment issue has been discussed in different proposals over the years, so it is <br />gratifying to know that closure appears to be in the near future, <br /> <br />City Planner Cary Teague reviewed four requests by Hermann's Mobil Station, 500 Old <br />Highway 8, The requests include: <br /> <br />1. SITE PLAN REVIEW for the construction of two canopies and remodeling of the car <br />wash, <br />2, TYPE IV NON-CONFORMING USE PERMIT for setbacks for drive and parking areas, <br />drive entrances as they relate to number per street frontage, drive aisle widths, <br />parking lot and drive aisle perimeter curbing, pavement of off-street parking <br />areas, and off-street parking area striping. <br />3. VARIANCE to set the canopy on Old Highway 8 closer than the code required 30 <br />feet. <br />4, SPECIAL USE PERMIT to locate both canopies up to 10 feet from each right-of-way <br />(if the variance is denied), <br /> <br />Teague explained the staff recommendations for approval of all the requests except that <br />for the variance. Staff did not believe this request exhibited a unique circumstance in <br />which a hardship would be brought upon the applicant should the variance be denied, <br /> <br />Larson noted that at the Planning Commission, the applicant indicated the southbound <br />cut from Old Highway 8 that goes into the area used by the truck traffic using the diesel <br />pumps is such that traffic is going over the curb, Widening this, instead of eliminating <br />it, would provide for better turn radius for the trucks using the diesel pumps and filling <br />the tanks, Teague noted that staff did agree with this request as shown in the report. <br /> <br />With regard to the parking and the truck traffic, Gunderman expressed some concern for <br />the consumer pumping gas. Hermann reponded that it did not appear there could be a <br />need for concern, however, if after the facility were in full operation using the proposed <br />changes, parking area could be decreased. <br /> <br />Motion by Gunderman, seconded by Hoffman, TO WAIVE TIlE READING AND ADOPT THE <br />STAFF RECOMMENDED RESOLUTION DENYING VN-318, DUE TO THE FACT THAT NO <br />HARDSIllP IS INDICATED TO WARRANT APPROVAL OF THE 25 FOOT CANOPY SETBACK. <br /> <br />5 Ayes, 0 Nayes, Motion carried, <br /> <br />Motion by Gunderman, seconded by Hoffman, TO WAIVE THE READING AND ADOPT TIlE <br />STAFF RECOMMENDED RESOLUTION APPROVING SP-204, SUBJECT TO APPROVAL OF LP- <br />340 AND Nc-llO. <br /> <br />5 Ayes, 0 Nayes.
