Mr. Peterson owns both lots and would like to increase the <br />buildable area of one to provide enough space to accommodate the construction of a <br />garage, Both lots are 30 feet in width at the front setback line, This is non-conforming, <br />however, this will not change with the approval of the request as the lot line change is <br />further back than the setback line. As a result, a non-conforming use permit is required <br />and recommended by staff for approval. <br /> <br />Mr, Peterson is proposing to locate the new garage in an open area. This location will <br />not have an unfavorable impact on the existing trees or disturb the berm to the north. <br />The current lot line divides this berm and tree line in the middle. The proposed <br />reconfiguration of lot lines will correct this, Teague also noted that, although not <br />verified, the berm is an old Indian burial mound which usually are located on high <br />ground overlooking a body of water, <br /> <br />Hoffman asked if staff or the Planning Commission had received any comments from <br />neighboring property owners. Teague responded that only one had been received and <br />that was from a neighbor concerned that the garage could block the view of Long Lake <br />from adjoining properties, He explained that this is a wooded lot and the existing view <br />of the lake from neighboring properties is questionable; therefore, the construction of a <br />garage should not change that. <br /> <br />Motion by Samuelson, seconded by Hoffman, TO WAIVE THE READING AND ADOPT <br />RESOLUTIONS AS RECOMMENDED BY STAFF TO APPROVE Nc-109 SUBJECT TO <br />CONDITIONS; AND PL-244 SUBJECT TO COMPLIANCE WIm Nc-109. <br /> <br />5 Ayes, 0 Nayes, Motion carried, <br /> <br />Teague reviewed the request of the Industrial Equities Group to consider the application <br />of a Site Plan for Phase 2 of the Brighton Corporate Park (PUD) and a Simple Plat to <br />create the lot on which the subject building is located, The subject property is located at <br />the south end of Fifth Avenue at the intersection of First Street. Phase 1 of Brighton <br />Corporate Park has been completed, <br /> <br />Teague advised that an office/warehouse is proposed for development on Phase 2 and is <br />a permitted use for the property zoned 1-2 (Heavy Industrial).
