<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />August 27, 1996 <br /> <br />Page 7 <br /> <br />Council Business. continued <br /> <br />Mattila presented a site plan review, nonconforming use permit, and a variance to <br />construct a 15-stall garage on a 27-unit apartment building, 1370 - 7th St. The garage <br />will improve site conditions, provide enclosed parking, and bring it further into <br />compliance with the parking ordinance. The applicant proposes to enclose the existing <br />dumpster. <br /> <br />The site was developed prior to current zoning regulations and is surrounded by other <br />apartments. It does not border a public street and is served by private driveways and <br />parking areas. Setback requirements are difficult to apply because the apartment does <br />not comply with R-3A setback standards except for the rear setback. The 10 ft. garage <br />structure would encroach upon the adjacent cemetery, however, the garage will be built <br />into a hill and will not be very visible from the R-l district. Also, there are two existing <br />garages similar to the proposal constructed five ft. from the cemetery. Due to existing <br />site conditions, the applicant is forced to violate the setback requirements in order to <br />provide enclosed parking. Strict enforcement would cause the applicant an undue <br />hardship because of not be able to put the property to reasonable use without a setback <br />variance. The Planning Commission recommended approval. <br /> <br />Motion by Williams, seconded by Gunderman, to WAIVE THE READING AND <br />ADOPT RESOLUTIONS APPROVING NC~103 AND N-307, SUBJECT TO <br />CONDITIONS; APPROVE LP-317 SUBJECT TO FOLLOWING CONDITIONS: <br />1. APPROVAL OF NC-I03 AND VN-307. <br />2. PROVISION OF A FOUNDATION PLANTING PLAN LETTER OF <br />CREDIT OR BOND IN THE AMOUNT EQUAL TO 100% OF THE COST <br />TO INSTALL THE PLANTING PLAN. <br /> <br />4 Ayes - 0 Nayes, Motion Carried. <br /> <br />Mattila presented a site plan review, nonconforming use permit, and a variance to <br />construct a small garage on an existing apartment site, 808 - 6th Ave. The parking lot <br />would be removed from the ROWand the new parking lot would be paved, curbed, and <br />striped. The garage would enclose two stalls and provide storage. The dumpster will be <br />enclosed. A 20 ft. front yard setback variance and a 45 ft. district line setback variance <br />is required. The unique circumstance is the building was built prior to current zoning <br />standards, and a railroad ROWand tracks separate the garage and property. Due to <br />existing conditions, the applicant violates front yard and setback requirements to provide <br />parking. The garage will be setback with the existing building, and will not be out of <br />character with nearby garages. Strict enforcement of the setback would cause the <br />applicant an undue hardship. The improvements bring parking closer into compliance, <br />and improves the site appearance. <br /> <br />Samuelson asked the project's time frame. Mattila said this project and the previous <br />project will begin construction this fall. The stalls will be for tenant use only. <br /> <br />Motion by Williams, seconded by Larson, to WAIVE THE READING AND ADOPT <br />RESOLUTIONS APPROVING NC-I02 AND VN-306, SUBJECT TO <br />CONDITIONS; AND APPROVE LP-316 SUBJECT TO FOLLOWING <br />CONDITIONS: <br />1. APPROVAL OF NC-I02 AND VN-306. <br />2.
