<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />May 28, 1996 <br /> <br />Page 5 <br /> <br />Council Business. continued <br /> <br />Motion by Williams, seconded by Larson, to AUTHORIZE LMCIT TO ENTER <br />INTO A CONTRACT WITH CORVEL ON THE CITY'S BEHALF. <br /> <br />4 Ayes - 0 Nayes, Motion Carried. <br /> <br />Police Chief John Kelley presented the Peddler's Permit for C.W. Marketing which <br />was continued from May 14. Staff reviewed documentation previously researched by <br />the City Attorney and ordinance requirement.'l, and did not find reason to deny permit. <br />Kelley received an application involving book orders from an out-of-state firm, and <br />noted concern regarding out-of-state transactions. In the past, they have rarely found <br />during the investigation an individual of questionable character. <br /> <br />City Manager Matt Fulton noted issues arising from limiting one type of peddler <br />versus another (private vs. nonprofit); and the interstate/intrastate selling of product. <br />By establishing practice by which one peddler is allowed and not another opens the <br />City to legal exposure. He believes managing a peddler's time frame and providing <br />information to residents regarding this activity is extremely helpful. <br /> <br />Gunderman asked if a peddler could be required to show identitication. Thomson said <br />identification could be a requirement of licensure, but he will need to research the First <br />Amendment issue. Gunderman asked if the City could provide a No Solicitation sign <br />in the City newsletter mailed to each residence. If placing the sign is legal for the <br />homeowner, Thomson feels there could be issue with the City expending funds to <br />provide signs. Gunderman asked if private donations could purchase the signs. <br />Thomson felt private donors can purchase signs and the City could distribute them. <br /> <br />Larson received calls from three community organizations who support the <br />continuation of door-to-door sales. <br /> <br />Motion by Larson, seconded by Benke, to ISSUE A PEDDLER'S PERMIT TO <br />C.W. MARKETING SERVICE, INC. FOR THE PERIOD OF MAY 29-JUNE <br />29, 1996. <br /> <br />4 Ayes - 0 Nayes, Motion Carried. <br /> <br />Williams requested future applications include a prototype of the product being sold. <br /> <br />Mattila presented the site plan review for an 8,100 sq. ft. office/warehouse on the <br />northern piece of the Robinson Coach Site near the City's northern border. The <br />applicant is McKinley Hill, Inc. The site plan complies with I-I district standards and <br />the parking ordinance. The Planning Commission recommends approval. Larson <br />confirmed that the one way access will be clearly marked. <br /> <br />Williams asked if the City Forester reviewed the landscape plan. Mattila said the City <br />Forester felt some species were not New Brighton hardy and recommended those <br />replaced with Black Hills Spruce.
