<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />May 14, 1996 <br /> <br />Page 4 <br /> <br />Council Business continued <br /> <br />Benke said the proposal involves only $5,000-7,000 worth of equipment considered <br />exclusive to the program, and other FSC events will use many of the furnishings. <br />Anderson said they could resell much of the furnishings if the program was <br />discontinued. Anderson said minor modifications will be made to the kitchen. <br /> <br />Motion by Samuelson, seconded by Larson, to AMEND THE 1996 BUDGET BY <br />ADDING $31,395.10 TO THE CONGREGATE DINING BUDGET AND <br />AUTHORIZING STAFF TO PURCHASE UP TO $31,395.10 IN BUILDING <br />FURNISHINGS. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Gunderman requested discussion regarding Report 96-096, CW Marketing Peddler's <br />Permit. He noted basic concern of residents' health, welfare, and safety, and does not <br />see benefit in allowing door-to-door sales in New Brighton. He verified that the permit <br />fee was increased from $30 to $45. <br /> <br />Fulton said the application form was modified last year, and a background criminal <br />investigation is made on all persons noted in the form. The investigative process has <br />become more enhanced and is according to ordinance requirements. In this case, the <br />applicants were found to be in good business character. Eichers asked if the background <br />check involves criminal activity occurring outside the county of residence. Fulton is <br />unsure whether the investigation was county or statewide. <br /> <br />Samuelson agrees with Gunderman, and hopes that peddling will be not used as a <br />diversion to other activities or cause harm to any resident. A thorough investigation is <br />important. <br /> <br />Benke said the City cannot legally ban certain door-to-door sales. All peddling would <br />need to be banned including sales by community service organizations. The question is <br />how extensive is the background check and does the permit fee allow for FBI checks. <br /> <br />Gunderman asked which businesses are participating in the coupon books. Benke said <br />community organizations frequently sell coupon books which feature local businesses, <br />but CW Marketing is a private business. <br /> <br />Motion by Gunderman, no second, DENY THE PEDDLER'S PERMIT FOR CW <br />MARKETING SERVICES. <br /> <br />Motion died to lack of second. <br /> <br />Williams said additional information is needed before Council approval, and requested <br />information regarding the businesses advertised in the books. <br /> <br />Benke asked the City Attorney to research this issue. Williams said the City Attorney <br />previously researched the issue last year, and he would not recommend additional <br />research which involves legal fees. Williams prefers that Fulton study the research <br />previously conducted by the City Attorney. Larson requested the coupon book be <br />brought to the upcoming Council meeting.
