<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />September 26, 1995 <br /> <br />Page 4 <br /> <br />Public Hearing. continued <br /> <br />Mr. and Mrs. Flekke, owners of Lot 2, plan to construct a home on the new lot with <br />a 30 ft. front yard setback. The existing homes along 23rd Ave. in this neighborhood <br />were built more than 40 years ago and are located on 270 ft. deep lots with 60 ft. <br />front yard setbacks. Mattila researched many City files and ordinances, but could not <br />find evidence of a 60 ft. frontyard setback requirement or covenant in this area. The <br />neighbor to the south would like to see any home constructed on the lot to have a 60 <br />ft. front yard setback to match existing setbacks. Mattila said the current minimum <br />setback requirement is 30 ft., however, staff would prefer the Flekkes place the new <br />home in such a fashion as to compliment the established setback line of 60 ft. <br /> <br />Howard Siebert, neighbor to the south, feels the setback consistency should be <br />preserved. Mattila could not find the zoning ordinance in effect at the time these <br />home were constructed, but does not feel the setback requirement was 60 ft. because <br />the City has carried through a 30 ft. setback throughout many other ordinances. <br />Mattila feels most likely the contractors followed a pattern of 60 ft. setbacks in this <br />neighborhood. Mattila noted that a resident could construct an addition to the front of <br />their home up to that 30 ft. setback. <br /> <br />Larson verified that the homes on the east side of 23rd Ave. are setback 30 ft., and <br />the homes on the west side are setback 60 ft. Siebert said the reason the east side <br />homes are setback 30 ft. is that their backyards drop off suddenly. <br /> <br />Lorraine Peterson, 669 - 23rd Ave., lives on the east side and feels constructing a <br />home on the west side with a 30 ft. setback would take away from the neighborhood's <br />architecture and landscaping. She feels that if the applicant built the home with a 40 <br />ft. setback this would help the situation. Gunderman confirmed that Mattila's <br />recommendation is that he would encourage the applicant to build the home further <br />back, however, the City can not enforce this. <br /> <br />Shirley Flekke, 2321 - 7th St., intents to build a home with its garage even with the <br />garage on the corner. The home would be setback from the garage to create a step <br />effect to blend in well with the neighborhood. She feels setting the home back further <br />could create drainage problems because of the steeper elevations of neighboring <br />properties. She added that a 12-15 ft. lilac hedge which sits near the southern lot line <br />would help to camouflage the home. <br /> <br />There were no further comments from the audience. <br /> <br />Motion by Williams, seconded by Samuelson, to CLOSE THE PUBLIC <br />HEARING. <br /> <br />4 Ayes - 0 Nayes, Motion Carried. <br /> <br />Hearing was closed at 7:55 p.m. <br /> <br />Mattila showed the location of the lilac hedge. Williams said it appears that this <br />hedge would screen the new home from properties to the south.
