D & T <br />Trucking is located at 498 Pirst St. NW in the Brighton Corporate Park. <br /> <br />Some modifications are needed to the proposed purchase agreement and the changes <br />primarily relate to the underground tanks and environmental testing on the site. Dolle <br />has agreed to remove the three underground tanks on the site instead of allowing the <br />City to do environmental testing around the tanks. The tanks are old and are the <br />primary potential risks on the site. Their removal eliminates the risk and is the best <br />way to ascertain whether they have leaked. Tank removals must follow MPCA <br />regulations. <br /> <br />Under the original agreement, the City would have had to remove the tanks. <br />Requiring D & T to remove the tanks makes them clearly responsible for clean up. <br />The tanks will be removed within 45 days of the execution of the purchase <br />agreement. The transfer of the property will not occur until the tanks are gone and <br />no further testing or clean up is required. The City will reimburse D & T for the <br />removal of the tanks. <br /> <br />Benke asked that in the event a problem is found would it then be Dolle's <br />responsibility for the remediation. Locke confirmed that if a problem is found, it is <br />Dolle's responsibility for remediation, and the City would have the ability to cancel <br />the purchase agreement at that time. <br /> <br />Motion by Gunderman, seconded by Williams, to WAIVE THE READING AND <br />ADOPT THE RESOLUTION APPROVING THE REVISED PURCHASE <br />AGREEMENT AND AUTHORIZING THE MAYOR AND CITY MANAGER <br />TO EXECUTE IT. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />City Engineer Les Proper presented the lighting system change order for the Silver <br />Lake Road reconstruction project. <br /> <br />Collins Electric, the subcontractor for the project, has suggested a change to lighting <br />standards included in the specifications. The Sterner Executive style luminaries and <br />aluminum poles chosen by Council are rather uncommon and expensive. Collins <br />proposes to substitute a Millerbernd pole and Hubbell luminaries for a $90,000 <br />deduction in the contract price for the lighting system. Proper has reviewed the <br />Millerbernd and Hubbell lighting system and did not notice a difference between <br />these and the Sterner style. The Millerbernd poles are steel rather than aluminum and <br />will require occasional painting.
