<br />Council Meeting Minutes <br />May 9, 1995 <br /> <br />Page 4 <br /> <br />I <br /> <br />Public Hearing <br /> <br />Benke feels giving the applicant an opportunity to discuss the matter with the other <br />property owner, may remove the non-conformity. Williams agrees with Benke. <br />Benke would like the issue facilitated quickly. Samuelson agrees the applicant should <br />not be penalized for the nonconformity, but the issue should be resolved. <br /> <br />Motion by Williams, seconded by Samuelson, to CONTINUE CONSIDERATION <br />OF PL-217 TO THE MAY 23, 1995, COUNCIL MEETING. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Public Hearin& - 8:01-8:04 p.m. - Minor Subdivision - PL-216 - Kristyniak <br /> <br />Mattila presented a request to split an existing single family parcel into two single <br />family lots. The property located at 778 - 5th Avenue NW contains a single family <br />home and detached garage. All structures comply with setback standards. <br /> <br />There were no comments from the audience. <br /> <br />Motion by Samuelson, seconded by Williams, to CLOSE THE PUBLIC <br />HEARING. <br /> <br />I 5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Hearing was closed at 8:04 p.m. <br /> <br />Motion by Gunderman, seconded by Larson, to WAIVE THE READING AND <br />ADOPT THE RESOLUTION APPROVING PL-216. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Council Business <br /> <br />Fulton presented an update on the Blue Bell Ice Cream peddler's license request. <br /> <br />Staff performed a thorough review of the application and found the applicant and <br />associates to be of sound business character and recommends approval of the license. <br />However, staff feels the application process should be improved upon to secure that <br />all information is identified within the form. <br /> <br />I <br /> <br />Gunderman originally deferred the request and now feels his concerns were <br />answered.
