Fulton has not researched which fund deposited <br />the proceeds, but the proceeds have not been expended and revenue will be applied <br />into the Stormwater Fund. Fulton will research if other expenses were associated <br />with the settlement, and feels the stormwater utility fund should not bear the cost. <br /> <br />Motion by Williams, seconded by Larson, to APPROVE THE QUOTATION <br />FROM FRATTALONE EXCAVATING IN THE AMOUNT OF $19,725 FOR <br />GRADING AND EROSION CONTROL WORK ALONG THE SOUTH SIDE <br />OF THE CITY DRIVING RANGE PROPERTY; AND REQUEST THE CITY <br />MANAGER TO INVESTIGATE THE USE OF THE SHAFER SETTLEMENT <br />AS A POSSIBLE MEANS OF OFFSETTING THIS COST. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Mattila presented the site plan review and special use pewit to construct an addition <br />onto the existing New Brighton Care Center, 550- 8th St. NW. The addition <br />complies with B-4 district and parking requirements, and will have minimal impact on <br />surrounding uses. The expansion would increase the size of the nursing home, but <br />not the number of residents. The addition will look more residential and complement <br />the townhomes, and off-street parking will accommodate employees and residents. <br /> <br />The Planning Commission recommends approval, but had concerns regarding the <br />original site plan. The amended site plan includes improvements such as dumpster <br />enclosure relocation, 5th Ave. sidewalk, larger windows along eastside, and siding on <br />existing building. The applicant wished to use shingles for the peak roof, but the <br />Uniform Building Codes requires metal roofing. Benke verified that the nature of the <br />facility requires metal roofing. Mike Chies, applicant, will conform to building <br />requirements. Chies met with the owners of the nearby apartments, and found one <br />owner was not supportive of vacating 6th Ave. He recommends 6th Ave. be retained <br />to provide access. This issue will be brought back to Council to provide off-street <br />parking. Larson feels vacating 6th Ave. may encourage apartment residents to park <br />in the nursing home lot. Chies and Proper are in agreement with snow storage. <br />Samuelson asked if additional greenspace will be added. Mattila said existing green <br />space will remain, and additional green space would be added near the townhomes. <br />Chies thanked staff for their assistance. <br /> <br />Motion by Samuelson, seconded by Larson, to WAIVE THE READING AND <br />ADOPT THE RESOLUTION APPROVING SP-184; AND APPROVE LP-295, <br />SUBJECT TO THE FOLLOWING CONDITIONS: <br />1. APPROVAL AND CONTINUING COMPLIANCE WITH SP-184. <br />2. ADDITIONAL LANDSCAPING INSTALLED AT NORTHWEST AND <br />NORTHEAST CORNERS OF PROPOSED PARKING LOT PER CITY <br />FORESTER'S APPROVAL. <br />3. APPROVAL OF GRADING AND DRAINAGE PLAN BY CITY <br />ENGINEER. <br />4.
