(Samuelson abstained) <br /> <br />Mayor Benke PROCLAIMED FRIDAY, MAY 19,1995, AS POppy DAY IN <br />THE CITY OF NEW BRIGHTON. <br /> <br />Consent Aflenda <br /> <br />Gunderman requested Report 95-057, Blue Bell Ice Cream Peddler's License, be <br />moved to the Council Business agenda. <br /> <br />Motion by Samuelson, seconded by Williams, to APPROVE THE CONSENT <br />AGENDA ITEMS AS FOLLOWS: <br /> <br />1. <br /> <br />CONSOLIDATED VOUCHERS: 063355-063548 FOR A GRAND <br />TOTAL OF $607,771.25. <br /> <br />3. CONSIDERATION OF APPROVAL TO ACCEPT THE 1994 ANNUAL <br />REPORT FOR THE FIREFIGHTERS' RELffiF ASSOCIATION. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />Public Hearin& - 7:36-7:42 p.m., Industrial Minor Subdivision - PL-215 <br /> <br />City Planner Erny Mattila presented a request to subdivide two existing industrial lots <br />and create a Registered Land Survey. <br /> <br />The applicant, Property Management/Investment Club, wishes to reconfigure the lot <br />line between two existing lots at lool-1021--1st St. The area is zoned 1-3, Light <br />Industrial, however, the north and west properties are residential and the east and <br />south properties are industrial. The applicant proposes to alter the center lot line so it <br />parallels the center line of Co. Ditch #2 and locates both buildings on the west lot. <br /> <br />The occupied portion contains several non-conformities and violates 1-3 district <br />permitted use standards. The proposed lot split would place all development and <br />nonconformities on the west, thus intensifying the non-conformities. The vacant <br />portion could be developed with a permitted use, but would be located adjacent to the <br />nonforming use. Because of these conditions, staff recommends denial of the <br />proposed lot split being that it would intensify the non-conforming use of that parcel. <br /> <br />Benke noted that both tracts and the buildings are under common ownership so the <br />location of the property line is not a problem. Benke asked what would be the <br />practical use of the parcel if it were subdivided.
