The storm sewer <br />costs are assessed to properties south of Foss Rd. where the storm sewer was <br />installed. The storm sewer was installed to correct local drainage problems that <br />affected most residents in the area, staff proposes to assess on a per lot basis, the <br />same as the street portion. Dividing the street costs portion by 398 lots results in an <br />assessment rate of $455.62 per lot. The storm sewer portion would be divided by <br />300 lots assessed south of Foss Rd. and results in a storm sewer assessment cost of <br />$36.69 per lot. The assessment rate for those properties north of Silver Lane would <br />be $455.62 per lot; properties south of Foss Rd., $492.31 per lot. <br /> <br />Benke noted that the Silver Oaks Condominiums will be assessed at a 4 lot amount. <br />Proper noted that the developer requested this assessment procedure and staff felt the <br />4 lot amount was correct. Benke noted that Project 92-14 was charged at a per unit <br />basis; but this appears to be an equal division of the assessment. <br /> <br />Resident, 447 Rolls Rd, questioned if Mr. Pahl's sewer gas odor may have been <br />created when a large area was refilled. Proper noted that staff was very concerned <br />about road settlements because of the area's soil. The resident does not feel that <br />area was compacted correctly. Proper will investigate this. Proper verified that no <br />State or Federal funds were used in the project. <br /> <br />Ann Perez, 681 Riviera Ct., recently purchased the property and asked who is <br />responsible for the assessment. Proper said that typically the seller would put funds <br />in escrow to pay the assessment. Benke said the purchase agreement should have <br />provided for payment by the seller. Thomson stated that if the agreement states the <br />seller is obligated to pay the assessment, then Perez should contact the seller. <br /> <br />There were no additional comments from the audience. <br /> <br />Motion by Samuelson, seconded by Williams, to CLOSE THE HEARING. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Hearing was closed at 9:36 p.m. <br /> <br />Motion by Gunderman, seconded by Benke, to WAIVE THE READING AND <br />ADOPT THE RESOLUTION APPROVING SPECIAL ASSESSMENTS ON <br />PROJECT 93-1 STREET RECONSTRUCTION; WAIVE THE READING AND <br />ADOPT THE RESOLUTION ORDERING PAYMENT OF SANITARY <br />SEWER REPAIR COSTS ON PROJECT 93-1 FROM SANITARY SEWER <br />UTILITY FUND; AND WAIVE THE READING AND AOOPI' THE <br />RESOLUTION ORDERING PAYMENT OF CITY STORM SEWER RIGHT- <br />OF-WAY COSTS ON PROJECT 93-1 FROM STORM WATER <br />MANAGEMENT FUND. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Public Hearing - 9:41-9:42 p.m. - Project 93-6 - North Innsbruck Drive <br /> <br />The project consists of the reconstruction of N.
