<br />Council Meeting Minutes <br />September 12, 1994 <br /> <br />Page 4 <br /> <br />Council Business. continued <br /> <br />As advised by the City Attorney, the City is not allowed to preclude adult use <br />q,fjented businesses from coming into the community, but the City can guide where <br />thtlse businesses would be located according to land use regulations. This one year <br />mdratorium provides that during the moratorium period adult use establishments can <br />not be located within 1,000 ft. from the nearest property line of any land in a <br />residential zone, public day care, library, religious institution, playground or other <br />public recreation facilities within any zoning district. This moratorium would <br />provide the adequate time to prepare the necessary permanent regulations so that this <br />type of land use is done consistent with appropriate zoning regulations. <br /> <br />Benke noted the recent redevelopment projects in Olde Town and the Rice Creek <br />Center, and feels the moratorium will give the City time to sort out issues and <br />impacts of this business use. He supports the moratorium. <br /> <br />Motion by Samuelson, seconded by Larson, to WAIVE THE FIRST AND <br />SECOND READING AND ADOPT AN ORDINANCE FOR TIlE <br />PLACEMENT OF A MORATORIUM ON THE CITING OF ADULT USE <br />ESTABLISHMENTS WITlDN ANY ZONING DISTRICT WITHIN THE CITY <br />AND DIRECT TIlE STUDY BE COMPLETED OVER THE NEXT YEAR. <br /> <br />3 Ayes - 0 Nayes, Motion Carried. <br /> <br />Benke presented the appointment to the TCAAP reutilization committee. <br /> <br />Under the leadership of Congressman Bruce Vento, the committee will be composed <br />of representatives from different areas of interest. The committee will assist in the <br />planning of the future use and redesign of the TCAAP Plant. The City has been <br />asked to appoint a person to represent the City on this committee. In addition to a <br />City representative, residents are encouraged to participate on this committee. <br /> <br />Benke noted that Council members have been given the opportunity to participate on <br />this committee. Because of Fulton's expertise in community development and <br />redevelopment activities, he would endorse the nomination of Fulton to serve as the <br />City's representative. <br /> <br />Samuelson feels it is appropriate to appoint Fulton. Larson agrees. <br /> <br />Williams arrived at 7:45 p.m. <br /> <br />Benke said the committee will deal with issues relating to redevelopment of the site <br />to accommodate appropriate areas for housing, commercial and industrial use. <br />While the site is remediated, the committee will develop recommendations for the <br />clean-up, redesign and conversion of the site. The site's redevelopment is of high <br />concern and interest to the City.
