<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />January 25, 1994 <br /> <br />Page 9 <br /> <br />Council Business. continued <br /> <br />Fulton confirmed that the reforestation of the park will be of major emphasis in the <br />first year. <br /> <br />Benke requested that persons selling homes in this area should be notified that the <br />plan has been established and there is probability that trails will be installed. <br /> <br />Meeting temporarily adjourned at 9:50 p.m. <br /> <br />Meeting reconvened at 10:00 p.m. <br /> <br />Nelson Hard, Citizen Study Committee (CSC), explained that Council referred to <br />the CSC for consideration the subject of allowing peddlers and solicitors to operate <br />in the City. <br /> <br />The CSC reviewed the existing code, Police Department investigative reports, <br />previous reviews, and information from the League of Minnesota Cities. The <br />information from staff and the Police Department found that very few complaints <br />regarding this activity are received. If a resident wishes, the ordinance states that a <br />homeowner who does not wish this activity, can place a statement in their window. <br />If a peddler. ignores this sign, they could be charged with trespassing. <br /> <br />Mr. Hard noted that a very workable licensing process now exists and allows for <br />selective enforcement and waiving of fees for non-profits. Previous legal review of <br />the ordinance suggests that prohibition of anyone group is difficult and the <br />ordinance would need to prohibit all groups in order to be legally viable. The CSC <br />recommends no changes to the code relating to peddlers and solicitors. <br /> <br />Gunderman agrees with the CSC recommendation. He noted that he would be very <br />surprised to see that all of these peddlers are actually licensed by the City. Nelson <br />feels that the trespassing signs could serve a purpose for some residents. <br /> <br />Samuelson asked what preceded the request for this study. Gunderman said Council <br />requested this investigation because of the amount of groups who are soliciting in <br />the. area and whether this activity is considered correct. <br /> <br />Benke requested that a summary of this recommendation be published in an <br />upcoming "In the Neighborhood" issue. <br /> <br />Gunderman suggested that licensed peddlers could wear some type of badge <br />identifying their City license. <br /> <br />Williams asked how difficult it is for a citizen to bring about a trespassing charge. <br />LeFevere said the citizen would need to file a complaint and eventually go to court, <br />however, most cases do not go to trial. LeFevere added that a standard could be <br />installed which would deny a license to an applicant who has a criminal background. <br /> <br />Council thanked the CSC for their work on the issue. <br /> <br />City Planner Erny Mattila presented the site plan review to construct a 6,045 sq. ft. <br />manufacturing building in an industrial district.
