<br />Council Meeting Minutes <br />September 28. 1993 <br /> <br />Page 1 2 <br /> <br />Council Business. continued <br /> <br />Gunderman asked if all door-ta-door sales could be outlawed. LeFevere <br />said the City could disallow door-to--door sales, but there needs to be room <br />for free speech and religious activities. The City could further regulate or <br />prohibit door-to-door activities by greater licensing and limitation <br />requirements. Gunderman suggested that the CSC research the issue <br />further, and feels this is an important issue in regards to security. <br /> <br />Mr. Hall is willing to undergo a background check on his firm. Benke said <br />that Council is not questioning the integrity of the Edward Jones Company, <br />but their method of door-ta-door contact. <br /> <br />Williams is not convinced that Mr. Hall is not trying to sell something and <br />feels the senior population is wlnerable to this sort of sales method. <br /> <br />Gunderman feels that an ordinance should be put in place to reflect the <br />Council concerns. <br /> <br />Larson said the intent of his motion is to address the problem and table all <br />requests until further study. There was some discussion regarding the <br />recommended timeframe for the CSC recommendation. Benke feels the <br />CSC will encounter the same issues and dialogue the Council has wrestled <br />with, and is unsure they will be able to come up with a recommendation in <br />such a short timeframe. <br /> <br />Jeanetta said staff prepared preliminary work on the issue and asked if the <br />CSC could consult other groups about alternative marketing tactics. <br /> <br />LeFevere noted that the Police Chief feels that it is counter-productive to <br />create elaborate background investigations for such licenses. <br /> <br />Gunderman noted that the intent of Larson's motion is to eventually <br />eliminate all door-to-door sales. Rebelein suggested that the CSC <br />investigate whether this concept is workable and what is the impact. <br /> <br />Benke suggested that the CSC recommendation be presented to Council on <br />December 14. Rebelein suggested that the CSC look at alternative ways <br />for other groups to market their goods. <br /> <br />Mr. Hall asked if he could hand out literature and questioned the free <br />speech issue. LeFevere said commercial free speech is entitled to limited <br />protection, but is not entitled to the same kind protection that political or <br />ideological speech has under the First Amendment.
