Ms. Elkins said the Fire Marshal and applicant <br />have reached a comprise on the sprinkler issue, but the biggest concern is <br />the immediate costs for paving and curbing. Benke asked if a time limit <br />could be added to the bond to allow additional time to install the <br />improvements. <br /> <br />LeFevere said the owners are prepared to provide the bond, but are unsure <br />when improvements could be completed. Council could specify a date in <br />which the improvements are to be made and require a bond to be posted to <br />insure that those improvement are completed by that date. <br /> <br />Rebelein verified that if the improvements are not completed by a specific <br />date, the bond proceeds will be used for the improvements. LeFevere <br />noted that a bond provides that security to the City. <br /> <br />Mattila said the applicant has proposed a four year period for those <br />improvements to be completed. Ms. Elkins said the owners are committed <br />to completing the improvements by no later than January 1, , 999. It is <br />their hope that the improvements and the assisted living project will be <br />completed at the same time. <br /> <br />The Planning Commission held a publiC hearing and recommends approval. <br /> <br />Benke feels the improvements should be deferred for only two years. <br /> <br />Gunderman questioned whether this action should be tabled so that the <br />City's legal staff and the applicant could devise a timeline. <br /> <br />Motion by Gunderman, seconded by Larson, to APPROVE SP-180 AND NC~ <br />95. <br /> <br />No Vote Taken. <br /> <br />Rebelein suggested that the Gunderman motion be amended to add that the <br />parking area improvements be installed before January 1, 1996. <br /> <br />Williams asked what type of materials will be used for the parking lot <br />before the improvements are made and questioned possible drainage issues. <br />Mattila said the applicant proposes a Class 5 material be used in the parking <br />lot, and in regards to drainage, the Rice Creek Watershed District would <br />need to approve the permit. Ms. Elkins said a proposal has been submitted <br />to the Rice Creek Watershed District. <br /> <br />Mattila said the Planning Commission noted concern of the parking situation <br />and requested it be completed in a reasonable time period. Rebelein noted <br />that the proposal provides for adequate off-street parking, but the area <br />would not be curbed or paved. <br /> <br />Larson noted that the City requires other projects to complete their paving <br />and curbing plans according to standards.
